The regular meeting of the Danbury Township Board of Trustees held September 28, 2011 at 7:00 p.m. was called to order by President Ms. Dianne M. Rozak, with Ms. Rozak, Mr. Charles B. Scott, and Mr. David M. Hirt in attendance. Also, present Fiscal Officer -Shelley Seamon, Police Chief- Mike Meisler, and Road Superintendent-Jim Dress.
Visitors attending were, John Sherry, Gary Reep, Matt Seamon, Gloria Rhyner, John Rhyner, Peter Corrado, Rita Mahler, Lisa Bruno, Tony Novak, Jodi Kopanski, and Mark Scagnetti.
Approve Minutes The minutes of the regular meeting held September 14, 2011 were approved as submitted.
The minutes of the following special meetings were approved as submitted, September 6, 2011, September 13, 2011, and September 15, 2011.
Correspondence The township received the following correspondence:
Ms. Rozak read a letter sent to Police Chief Mike Meisler, from Nancy & Sonja Kristensen, which commended the department and noted Officer Cunningham’s promptness after being called. Ms. Rozak read the card sent to Police Chief Michael Meisler, from The England and Lamh families, which expressed their appreciation that Chief Meisler handled the funeral procession for Mr. Richard England Sr.
Ms. Rozak read the email received from Cheryl Harner, in which Ms. Harner expressed the overwhelming consensus of positive comments regarding Meadowbrook Marsh.
Ms. Rozak read excerpts from the Midwest Birding Symposium complimentary blogs posted which resulted from the birding event held Saturday, September 17, 2011, which included visiting Meadowbrook Marsh. Roads, Buildings, and Grounds Mr. Scott reported that the maintenance department had been busy mowing and trimming. The garages were cleaned in preparation for the upcoming auction on Saturday, October 15, 2011. The gardens at Lake Point Park and Battlefield Park were prepared for the approaching winter season. Barnes Nursery will be completing the grinding at the brush drop-off site on Thursday, September 29, 2011. The cable at the brush drop-off site will be adjusted once the area is closed to enable citizens’ entry to the dog park. Mr. Scott reported that the Sterling was taken to Norwalk Truck Sales & Service for a preseason maintenance check. It was determined that cracked brake shoes would have to be replaced on the front and in the rear. Because of the amount of funds being spent to repair the Sterling over the past years, Mr. Scott said it would be a better use of taxpayer money to replace the Sterling and postpone the repaving project for Northshore Boulevard for two years.
After discussing the matter, the trustees agreed to pursue replacing the Sterling and revisit the possibility of repaving Northshore Boulevard next spring.
Mr. Scott reported that cracking sealing was gearing up. Mr. Scott said he and Mr. Dress discussed if an off duty police officer could assist with flagging traffic while Northshore Boulevard was being sealed as a safety measure for the staff. Chief Meisler agreed to assist and Mr. Scott asked that Chief Meisler and Mr. Dress work out the details.
Mr. Scott reported that Catawba Island Township had requested to use the crack-sealing machine. Mr. Scott said equipment sharing was becoming quite popular. A brief discussed was held and the trustees agreed to allow Catawba Island Township to use our crack-sealing machine. Mr. Dress will contact Dan Barlow to work out the details.
Mr. Scott reported that Mystic Bay Boulevard was paved and no decision regarding lowering speed limits on six township roads has been reached by ODOT. Surplus Property The board reviewed the lists of surplus property to be auctioned off on Saturday, October 15, 2011 at the police station located at 419 S. Bridge Road, beginning at 11:00 am.
Mr. Scott asked the board if they wanted to place a minimum bid for the 1989 Dump Truck. Mr. Hirt said he did not foresee one was needed. Mr. Scott said that the truck had rust issues. Mr. Dress said that the truck had a broken hinge and cylinder, but it was a good running truck.
Mark Scagnetti said that every auction has a built in reserve. Mr. Scagnetti also said the auctioneer has the authority to pull an item from the auction if the price offered is not high enough. The trustee(s) would then make the decision whether to accept the offer or pull the item. Ms. Rozak said the board needed to decide if a minimum should be put on any of the items or should the terminology be “make it go away”. The trustees agreed not to require a minimum bid on anything and that all items were to be auctioned as is.
A discussion regarding where the list of items will be published and if an ad should be placed in the newspapers occurred. Ms. Rozak said she would post the lists of surplus items on the website, which can be view by going to www.danburytownship.com and clicking on Current News. Ms. Rozak and Mr. Scott agreed with Ms. Seamon that an ad should be placed in the newspaper, but no decision was made on who would place the advertisement for the auction. Discussion concluded and the following action was taken.
Ms. Rozak moved to declare the items listed below surplus property of the road and police departments and to dispose of the surplus property through the Danbury Township Auction. Mr. Scott seconded the motion. All voted yes. Motion carried. Regarding the property seized as evidence, Chief Mike Meisler said that the list of such property was forwarded to the County Prosecutor, but he did not foresee that these items would be sold at the upcoming auction because of the length of time it takes to process the paperwork, which enables the disposal property seized as evidence.
A brief discussion of donating the Whelen Edge Patrol Car Strobe Light Bars to the Erie County Sheriff’s Department occurred, which resulted in the following action.
Mr. Hirt moved to donate four Whelen Edge Patrol Car Strobe Light Bars to the Erie County Sheriff’s Department as recommended by Police Chief Mike Meisler. Mr. Scott seconded the motion. All voted yes. Motion carried.
ADA Renovation Contract for Township Hall The trustees held brief discussion regarding the quote of $27, 525.00 that R.J. Runge Company had submitted for the ADA renovation of archway entrance at the township hall. Mr. Scott explained the scope of work and said that Bodner & Kerik Architects had prepared the contract between the township and R. J. Runge Company for this project. Mr. Scott reported that County Prosecutor, Mark Mulligan was reviewing the contract and Mr. Mulligan would notify the board as quickly as possible if any changes were necessary. A brief discussion was held regarding who was available to attend a special meeting on Friday September 30, 2011. The trustees agreed that Ms. Rozak be excused due to a prior commitment on the 30th of September. At the conclusion of discussion, the following action was taken.
The trustees will hold a special meeting on Friday September 30, 2011, at the Danbury Township Hall beginning at 5:00 p.m. for the purpose of accepting the quote and entering into a contract with R.J. Runge Company for the ADA renovations at the township hall.
Ms. Rozak will post notice of the special meeting on the township website and advise the local newspapers as well. Police Mr. Hirt reported that the police department handled 395 incidents to date in the month of September. Mr. Hirt reiterated the double-digit incidents handled; the top five were, Supplemental Reports-44, Assist other Danbury Units-37, Verbal Traffic Warning-32, Traffic Complaints-19, and Lakeside Calls-18.
With regard to the installation of a light at the police station entrance, Mr. Hirt asked Chief Mike Meisler if the representative from Ohio Edison had contacted him. Chief Meisler said that he had contacted representative about a week after he had stopped and was told the installation of the light was given back to Jeff Schmid. Chief Meisler recommended that the board contact Gary Mortus regarding the matter. Fire Mr. Hirt reported that the Marblehead Volunteer Fire Department handled forty-eight calls in the month of August. (9- Fire and 39- EMS)
Safety Ms. Rozak announced that a township safety meeting was scheduled for Tuesday October 25, 2011, with “Personal Protective Wear” being the topic of discussion. Ms. Rozak said that the meeting was not mandatory and those employees normally schedule to work should attend.
Zoning Ms. Rozak reviewed the following zoning report submitted by Walter Wehenkel, Interim Zoning Inspector and Deborah Burley-Burley. Danbury Township Zoning September 2011 Monthly Report September 26, 2011 Interim Zoning Inspector Walt Wehenkel took over September 1st as Interim Zoning Inspector with hours on Tuesday, 9:00am-12:00pm and Thursday, 4:00-7:00pm. It is working well in coordination with Assistant, Deb Biro. Permits Eight permit applications were processed thus far in September and a total of $666.72 collected in fees. Residential permits were issued for four new single-family homes: one at 2070 Baliwick, one at 89 N. Gravel Bar Rd., one at 8300 E. Bayshore Road, and a new manufactured home at 1815 Bayview Drive. In addition, one handicap ramp, one shed and one accessory building permits were issued. One application was rejected resulting in an application for an area variance for the October BZA meeting. One permit is awaiting Mr. Wehenkel’s approval and processing. Board & Commission Activity The Board of Zoning Appeals held a hearing in September for the following applications: #2011-120 area variance on a corner lot to allow one front yard of twenty(20) feet for the purpose of constructing a commercial boat storage building. The required setbacks for this corner lot are seventy (70) feet for one front yard and twenty-five (25) feet for the other. The applicant changed his request for 15 feet setbacks for the front and rear of the building. The Board approved the request and the variance. #2011-122 an area variance to allow side and rear setbacks of two and a half (2.5) feet for the purpose of constructing a garage. The required setbacks for an accessory building are five (5) feet from both the side and rear. The variance was continued to the next month. The Zoning Commission continued a review of proposed amendments to the L district for fences and also fence regulations in general for residential districts, along with consideration of concession stands in the township. The Zoning Inspector has spent a considerable amount of time on these revisions this month. The Township Trustees appointed two new alternates to the Zoning Commission and the office is getting them information and induction into the zoning procedures and resolution. Calls and Site Visits A primary activity of the Zoning staff is responding to inquiries from residents, developers, appraisers, contractors, etc. Inspections are performed to verify or identify violations as well as to verify that projects are completed in compliance with approved plans. In addition, the department staff greets visitors seeking information regarding other township services and directs them to the appropriate official or department.
During the month of September, the Department responded to 215 calls, e-mails and in-person inquiries and went on 8 site visits. Ms. Rozak provided answers to zoning questions she received via e-mail from Lisa Bruno.
Fiscal Report Fiscal Officer, Shelley Seamon presented the trustees with detailed reports regarding the financial status of the township as of September 28, 2011.
Insurance Renewal Ms. Seamon and the trustees discussed the Insurance Renewal Application received from the Hylant Group, which advised that building/contents and property values were increased 3%. Ms. Seamon questioned if the fencing for the dog park at 310 S. Bridge Road and the flagpole at 419 S. Bridge Rd should be added. The trustees discussed the matter and advised Ms. Seamon to obtain information regarding the savings to the township if fencing and flagpoles were dropped from the policy. Ms. Seamon questioned if the township should obtain Certificates of Insurance from the contractors performing construction, services, or maintenance on township property. Ms. Seamon said she felt it was necessary but would need the cooperation of the trustees and departments to obtain the information. The trustees agreed and Ms. Seamon will consult with the insurance carrier regarding the matter.
At the conclusion of the committee reports, Lisa Bruno asked Chief Mike Meisler questions regarding the S Curve on Bayshore Road, which included if any accidents had occurred this summer. Chief Meisler responded. Ms. Bruno then commented on the increase of traffic at S curve due to the repaving of State Route 163.
With regard to the notification in the township newsletter on developing a neighborhood watch program, Gloria Rhyner asked Chief Mike Meisler how many responses the department had received. Chief Meisler responded. Ms. Rozak dismissed Mr. Dress and Chief Mike Meisler at 7:53 p.m.
Regional Planning Commission Alternate Mr. Scott moved to appoint Vito Kaminskas the Regional Planning Commission Alternate. Ms. Rozak seconded the motion. All voted yes. Motion carried.
Name the Dog Park Contest Ms. Rozak explained that Stevie Rinaldo had informed her that she received a substantial donation to purchase a sign for the dog park. Ms. Rozak requested and received approval from the board to publicize a contest to name the dog park. Ms. Rozak will compose the advertisement and submit it to the newspapers. Ms. Seamon explained that a specific revenue code was established to track the donations to the dog park. Ms. Seamon asked if Ms. Rinaldo would provide a list of the donors for the township records. Ms. Rozak said she knew that the Girls Scouts were planning to donate a lump sum of money to purchase the sign.
Cost of Legal Ads Ms. Rozak advised the trustees that the rules regarding legal advertising had changed and now the township had the opportunity to publish legal ads in the Beacon. Ms. Rozak received a quote from the Beacon and the Peninsula News. Being that the quotes were presented differently, Ms. Rozak will contact John Schaffner at the Beacon, to obtain how his rate equates to a per column inch rate.
Nuisance Complaint Ms. Rozak read the complaint filed regarding the overgrown weeds on the property located at 604 West Second Street, which is just outside the gates of Lakeside. A brief discussion of the complaint occurred involving several points, which included if the home was occupied and was it a nuisance. The trustees agreed that Ms. Rozak would advise the property owner of the complaint by mail.
Jamison Cemetery Ms. Seamon informed the trustees that Jennifer James had inquired if the township was aware of the condition of Jamison Cemetery and if the township could assist in restoring it. Ms. Seamon provided the trustees with a file she found regarding the same matter investigated back in the year 2000. After discussing the matter, Ms. Rozak said she would review the file after the meeting. Ms. Rozak also said she would obtain a phone number to contact Greg Spatz and follow up with Deb Biro as well as Ms. James. Approve Payment of Bills After examining the following bills in the amount of $41,145.27, Mr. Scott moved that they be accepted and warrants for the various amounts be drawn. Public Records Training Mr. Hirt announced that Public Records training was available at the Niagara Visitors Center, on Put-In-Bay, October 7, 2011 and he would be attending.
Comments & Concerns During the Comment & Concern portion of the meeting, the following citizens interacted with the trustees, Rita Mahler and Lisa Bruno. The trustees received and answered several questions involving the zoning department and the way the Zoning Commission as well as the Board of Zoning Appeals meetings were being conducted.
The trustees received and answered concerns regarding the rules, regulations for the dog park as well as whose responsibility it was to ensure the rules, and regulations are followed.
The trustees received information that the Board of Elections does not require that the entrance for voting be the front entrance to the building. The trustees were asked if it would not have been cheaper to make the back entrance to the meeting room ADA accessible rather than the archway entrance. Ms. Rozak and Mr. Scott responded.
With regard to the township’s insurance policy renewal, a comment was received that the resident could not believe the township did not require that a contractor to provide a Certificate of Insurance when they were performing a service on township property. With regard to the Public Records training being offered at Put-In-Bay, the trustees were asked if the public could attend the training. Ms. Rozak and Mr. Scott responded, as did Mr. Hirt.
Executive Session Ms. Rozak moved to go into executive session for the purpose of discussing candidates for the positions of Zoning Inspector and Road Superintendent at 8:35 p.m. Mr. Hirt seconded the motion. All voted aye. Motion carried
Ms. Rozak moved to reconvene the meeting at 9:25 p.m. Mr. Scott seconded the motion. All voted yes. Motion carried.
Mr. Scott moved to appoint Brett Waldron to the position of Road Superintendent, effective January 3, 2012 at a rate of $20.50 per hour. Ms. Rozak seconded the motion. All voted yes. Motion carried.
Ms. Rozak moved to adjourn the meeting at 9:25 p.m. Mr. Scott seconded the motion. All voted yes. Motion carried.
