The regular meeting of the Danbury Township Board of Trustees held April 14th, 2010 at 7:00 p.m. was called to order by President Ms. Dianne M. Rozak, with Ms. Rozak, Mr. David M. Hirt, and Mr. Charles B. Scott in attendance. Also present: Fiscal Officer Shelley Seamon, Police Chief Mike Meisler, Road Superintendent Jim Dress, and Zoning Inspector Rhonda Botti Sowers.

Visitors to the meeting were: Rita Mahler, John Englebeck, Bruce Schermbeck, Matt Seamon, Nancy Kristensen, Sonja Kristensen, Randy Riedmaier, Paul Bauders, Loretta Grentzer, and Peter Corraxo.

Approve Minutes
The minutes of the regular meeting held March 24th, 2010 and the special meeting held March 30th. 2010 were approved as submitted. A correction to the minutes of the regular meeting held March 10th, 2010 was noted; the health insurance renewal date is April 1st, 2010 and not April 1st, 2009.

Correspondence
The following correspondence was received:
A thank you letter from Auxter Funeral Homes to Police Chief Mike Meisler and his staff for their assistance in a funeral procession held March 16th, 2010. The letter also acknowledged the dedication of dispatcher from the Ottawa County Sheriff’s Department on duty the that day
Mr. Pommeranz of BEC Associates sent notification to Michelle Bishop, Operations Manager of K F Ventures advising them that a portion of the bike trail they constructed at Meadowbrook Park has now settled and is holding water, asking Ms. Bishop to contact him to discuss how this problem can be corrected.
Invitation from The Village of Marblehead to participate in the Memorial Day Ceremony’s on Monday, May 31st, 2010 at the James Park War Memorial. Host of this year’s event is The Village of Marblehead.
Sheakley provided a no-cost quote for their Ohio Worker’s Compensation Group Rating Program.
The Board of County Commissioners will meet on May 13th, 2010 to discuss renaming E-Z Street to Easy Street in Danbury Township. The boards of trustees are not required to attend.

Committee Reports
Roads, Buildings and Grounds
Mr. Scott reported the maintenance dept. was busy at the brush drop off area and with township clean up. Stone topping has started at Lake Pointe Park. The park and cemetery clean ups have been completed. Mr. Dress attended the annual Ottawa County Township Association meeting on April 6th, 2010. The snow plows have been painted and are ready for storage. The batting cage installation is progressing. The purchase of the truck has been put on hold until August 2010. The 2010 Ford F-450 models are no longer available and 2011 Ford F-450 models only come with a diesel engine and this is an increase of $7,000.00. Mr. Scott reported VFW Post 7572 had donated new American flags to the township and he had prepared a thank note for them. Mr. Scott will be meeting with Mr. Dress regarding signage for the brush drop off area, which will list what is accepted as well as what is not.

Police
Police Chief Mike Meisler reported 245 incidents handled by his department in the month of March and 161 incidents to date in the month of April.


Fire
Mr. Hirt reported both the Lakeside and Marblehead Volunteer fire department s have been very busy with grass fires. There was discussion of the fire levy. Mr. Hirt reported that the departments will prepare a letter to the board of trustees with a joint recommendation for the levy. The deadline for the ballot is mid August and both departments are aware of this deadline.
Safety
Ms. Rozak reported Ms. Biro had forwarded the wage continuation policy for worker’s compensation as well as the safe work practices and procedures policy to the board by email. Both polices were reviewed by Marshall & Melhorn. The polices will be discussed at the next meeting. There will be an employee safety meeting held at the township hall on April 20th, 2010 at 8:30 a.m. Township safety polices will be reviewed and a fire safety program will be presented by Fire Prevention Officer, Roland Stucky. Ms. Rozak also reported she and Ms. Biro will be attending the annual meeting for Safety Council on April 21st, 2010.

Zoning
Zoning Inspector Rhonda Botti Sowers submitted a report listing 13 permits issued in the month of March and 7 permits issued to date in the month of April. Ms. Sower’s gave an overview of the monthly activity handled by the zoning department for the month of March and presented the board with the following detailed report.

Constitutionality of Zoning Restriction Upheld

On March 9 the Board received notice that the Ottawa County Common Pleas Court upheld the constitutionality of the zoning resolution as it applies to parking in the "L" Lakeside district on an appeal filed by Gerry F. Drackett, et al. The Board also received notice that oral arguments on another appeal filed by Ms. Drackett will be heard at the 6th District Court of Appeals on Wednesday, April 21. That case was previously decided in the township’s favor in the Ottawa County Common Pleas Court and was subsequently filed with the Appellate Court. Jeffrey Stopar of Eastman and Smith represents the township in these appeals.

Training & Professional Growth

The Zoning Inspector conducted a training session for Zoning Commission members, Township Trustees and Fiscal Officer on March 3 using information obtained at the Ohio Township Association Winter Conference. Among the items presented were public hearings, ethics and rules of procedure for Zoning Commissions.

The Zoning Inspector also conducted a brief training for the Board of Zoning Appeals members following their March 17 hearings. An in-depth training for the BZA is being planned for later this spring.

Board & Commission Activity

The Board of Zoning Appeals heard 2 cases in March as follows:
#010-10 variance to allow accessory structure in front yard denied
#019-10 variance to allow increase of a nonconforming house approved

The Zoning Commission had no hearings in the month of March but did initiate a text amendment pertaining to building height in the “L” district.

There were no hearings before the Board of Trustees during the month of March. A rezoning request at 2068 S. Meter Rd. which was approved February 24 went into effect March 26 and was filed with the Ottawa County Recorder.

Permits

Thirteen permit applications were processed during March and $675.04 collected in fees. There were two permits issued for new dwellings, both in the Bailiwick subdivision. Four permits were issued for residential additions as follows: two room additions, one covered porch addition and one conversion of a porch to living space. Two permits were issued for accessory buildings, one a shed and the other a garage. Two permits were issued for fences. One permit was issued for a change of use to convert an accessory structure to an art glass studio. In addition an application was processed to initiate text amendments and another was for modifications to a conditional use previously approved for Spyglass Condominium.

Permit activity for March was higher than the same period last year when there were 7 applications processed and $292.68 collected in fees. There have been 32 permits processed during the first quarter of 2010 compared with 18 permits during the first quarter of 2009.

Complaints and Violations

The return of warm weather signals the beginning of the building season and with it an increase in calls to verify whether zoning permits have been issued. There were 14 complaints/inquiries received during March. Permits had been issued for 12 of the properties. The other two were investigated and are in the process of being resolved. Permit holders are encouraged to post their permits so neighbors will know that a zoning permit has been issued.

Calls and Site Visits

A primary activity of the Zoning staff is responding to inquiries from residents, developers, appraisers, contractors, etc. Inspections are performed to verify or identify violations as well as to verify that projects are completed in compliance with approved plans. In addition, the department staff greets visitors seeking information regarding other township services and directs them to the appropriate official or department.

During the month of March 2010 the Department responded to 324 calls, e-mails and in-person inquiries and went on 34 site visits. Here is the breakdown:

Board of Zoning Appeals Hearing
The Danbury Township Board of Zoning Appeals will hold a hearing at the Danbury Township Hall, 5972 E. Port Clinton Eastern Rd., Marblehead, OH 43440 Wednesday, April 21st, 2010 beginning at 6:30 p.m. on the following application:
#032-10 by Port Charles Properties requesting a modification to the conditional use previously approved for the Spyglass Condominium at 7280 E Bayshore Road in the “R-C” Recreational-Commercial district. The modification would allow an addition to be constructed on the LCA house unit.
Set Zoning Hearing
The Danbury Township Board of Trustees will hold a public hearing beginning at 6:30 p.m. on Wednesday, April 28th, 2010 at the Danbury Township Hall, 5972 E. Port Clinton Eastern Rd., Marblehead, Ohio on the following application for amendment to the zoning resolution:
#021-10 for a text amendment initiated by the Danbury Township Zoning Commission on March 3rd, 2010 and modified at a hearing on April 7th, 2010 to amend regulations in the “L” Lakeside district pertaining to Lot Coverage, Building Height, and Building Width and to accurately reflect the legal name of The Lakeside Association.
Marine Patrol Funding
Chief Deputy Randy Riedmaier of the Ottawa County Sheriff’s Department, Marine Patrol was present to give detailed report of last year’s activity as well as request a donation to assist in funding this service.
Ms. Rozak moved to contribute $6,000.00 to the Ottawa County Sheriff’s Department, Marine Patrol with payment to be made from the General Fund. Second By: Mr. Hirt. Vote: Mr. Hirt-yes, Mr. Scott-yes, Ms. Rozak-yes. Motion carried.
Approve Taser policy
Ms. Rozak moved to approve the taser policy. Second By: Mr. Scott. Vote: Mr. Hirt-yes, Mr. Scott-yes, Ms. Rozak- yes. Motion carried.
Paving Quotes
Mr. Dress and Ms. Rozak presented the board with quotes on the following paving projects: Jeannie Drive - Cul-De-Sac, Meadowbrook Park - ADA parking spaces and bike trail continuation, and Lake Pointe Park - entrance. The quotes were as follows:

Approve Paving Quote
Mr. Scott moved to accept the quote from 7L Construction LLC in the amount of $16,370.00 for the three paving projects scheduled the breakdown per project was as follows: Jeanie Drive Cul-De-Sac $2,750.00, Meadowbrook Park- ADA parking spaces/bike trail continuation $9,220.00, and Lake Pointe Park-Entrance $4,400.00. Second By: Mr. Hirt. Vote: Mr. Hirt-yes, Mr. Scott-yes, Ms. Rozak-yes. Motion carried.

Credit Card Policy
The discussion continued on the recently adopted credit card policy. Ms. Seamon reported that the Lowe’s and Wal-Mart credit cards did not allow caps to placed and authorized signers were at the discretion of the business. The Staples credit card did allow caps and authorized signers. No information was obtained regarding the Shell credit card. Ms. Rozak contacted Brian Beck at The Friendship station and an in station credit card could be obtained. Ms. Rozak stated that with Lowe’s and Wal-Mart not allowing caps and authorized signers the credit card policy would need to be amended. Mr. Scott stated that the policy was acted upon to protect the fiscal officer and that there was never any question of impropriator or misuse of the credit cards by township employees. He stated it was obvious that the policy needed to be amended in a way in which it would protect the fiscal officer and not hinder the operations of the township. Ms. Sowers reported finding on the Auditor of State’s website that when a credit card issued to individual township employee it makes that individual response for the card. Ms. Seamon will contact Patricia Pepa at The Marblehead Bank to obtain information on having a MasterCard or Visa account set up where cards would be issued to specific township employees. The discussion will continue.

Meadowbrook Park Signage
Ms. Rozak reported the board had previously approved the purchase of a 3 panel informational sign for the Meadowbrook preserve from Allure Advertising at a cost of $500.00 per panel on June 24th, 2009 and that Mr. Dress would construct a permanent case for the signage. The original signage had photos on the middle panel, this panel will be eliminated. The trustees will purchase a two panel informational sign for the Meadowbrook preserve based on a cost of $500.00 per panel contracting with Allure Advertising.

Approve Property Purchase at 419 S. Bridge Rd., Marblehead, OH 43440
Ms. Rozak explained the purchase price of the property was $375,000.00 and that the recording fee was $48.50. Warrant # 34717 was issued in the amount of $373,708.45 payable to The Marblehead Bank to obtain a cashier’s check in the amount of $373,703.45 payable to Hartung Title Agency, Inc. to purchase the property and $5.00 was the cost of the cashier’s check, which was not included in the purchase price of the property. The township will assume the responsibility of paying the real estate taxes on the property in the amount of $1,345.55 which was withheld from the proceeds payable to Hartung Title Agency. The funds for the purchase were disbursed from the Road and Bridge and Police Funds based on the downstairs square footage being occupied by each department.
Mr. Scott moved to approve the purchase of the property at 419 S. Bridge Rd., Marblehead, OH 43440 in the amount of $375,048.50. The building will be utilized for a new police department and equipment storage for the road department. Second by: Ms. Rozak. Vote: Mr. Hirt-yes, Mr. Scott-yes, Ms. Rozak-yes. Motion carried.
Ms. Rozak reported the closing was scheduled at Hartung Title Agency on Thursday April 15th, 2010 at 11:30 a.m. Ms. Rozak also reported she had instructed Ms. Seamon to contact the insurance to have the building insured at a replacement value of $360,000.00 effective at midnight on April 15th, 2010. Ms. Seamon reported she had contacted the insurance company and insurance would be effective at midnight April 15th, 2010.

Discussion of the Building Inspection
The purchase of the property was contingent on the successful inspection report of the building. Mr. Scott reported that he had received the inspection report from Reliance Home Inspections Inc. The Wood Destroying Insect Inspection revealed no visible evidence of wood destroying insects observed. The Radon Test came back exceptionally low which is an excellent rating. Regarding the Home Inspection Test can back with only minor issues. Mr. Scott explained the minor issues found and reported the full 23 page report was yet to be received.

New Windows and ADA Accessible Doors
Mr. Scott presented the board with a preliminary quote from Capitol Aluminum Glass Corp. for new windows and ADA accessible doors for the existing township hall. The quote was as follows:
Window “A” Material & labor to install six (6) windows into two (2) openings. $10,650.00
Alt to #1 ADD 5/8” hinged mini-blinds with ¼” clear tempered dust shield to “A” type windows. $ 2,525.00
Window “B” Material & labor to install four (4) windows into one (1) opening. $7,500.00

Mr. Scott stated he had obtained the quote for the windows and doors to get an idea of what the cost was, but before acting on this project individually he felt that for the best interest of the township the remodeling of the existing township hall should be considered on the entire project. There was discussion that a firm could be contracted to prepare a plan and once the plan was complete then costs for each individual project would be broken down. The projects discussed were new windows and ADA compliant doors, remodeling of office space and ADA compliant restrooms. The discussion will continue.

Discussion of the 419 S. Bridge Rd. Property
Regarding the remodeling of the new building, it was discussed who would be contracted to do the remodeling for the new police department, if The Collaborative was not contracted the bid process would go back to square one, and if a square footage price of $85.00 or less could be negotiated if The Collaborative did the remodeling. Police Chief Mike Meisler stated he had prepared a rough sketch for the remodeling and that he would like to work with The Collaborative on the remodeling. The board will utilize the services of The Collaborative for the remodeling of the new police department. Police Chief Mike Meisler will work with The Collaborative. The discussion will continue.

Approve payment to Eastman & Smith for Zoning Legal Fees
Mr. Scott moved to approve payment in the amount of $21,773.19 to Eastman & Smith for services rendered from August, 2009 through February, 2010 which included a cost of $18,827.00 for appeals 07-CVF-508 and 07-CVF-509, Drackett vs. Danbury Township Board of Zoning Appeals, as well as $2,946.19 for consultation on a zoning issue in the Lakeside District. Second by: Ms. Rozak. Vote: Mr. Hirt-yes, Mr. Scott –yes, Ms. Rozak-Y. Motion carried.

Meadowbrook Park
Ms. Rozak reported The Natural Wave Salon had offered to provide cleanup at Meadowbrook Park and will also donate a bench. Mr. Scott reported the Firelands 4-H club will also be providing cleanup at Meadowbrook Park.

Ohio Utilities Protection Services
Ms. Rozak presented the board with the Ohio Utilities Protection Services. Mr. Dress explained the “Call before you dig process.” The memberships are based on how many tickets are issued in your township at $.12 per ticket. The Ohio Utilities Protection Service encourages political subdivision to join. One advantage of being a member is the township receive a notice 48 in advance of any utilities excavating going on in Danbury Township. The board will consider joining and discussion will continue.

Kelly Frye of the Ottawa County Sanitary
Mr. Scott reported that Kelly Frye from the Ottawa County Sanitary Engineer’s office will be at the next meeting to answer questions regarding the sanitary system at the township hall. Mr. Scott proposed to invite a local official of Ottawa County to speak at township meetings on a regular basis. Ms. Rozak suggested monthly, since the board receives police, and zoning reports monthly. Mr. Scott reported speaking to Ms. Seamon regarding preparing a monthly financial report in addition to the computer generated reports and the bank reconciliation’s.

Electric Aggregation Meeting
Ms. Rozak reminded everyone of the public meeting to be held at 6:30 p.m. at Danbury High School in the auditorium on Monday, April 19th, 2010, regarding the Electric Aggregation issue which will be on the May 4th ballot.


Comments/Concern
Sonja Kristensen asked if anyone was in charge of the Furniture Liquidation Outlet signs being placed in road right ways and on personal property without. Ms. Sower’s stated she was not aware of the signs. Ms. Sower’s will remove the signs if they are in the road right way and contact Furniture Liquidation Outlet.
Nancy Kristensen asked how much money had been spent on Meadowbrook Park. Ms. Rozak stated the township had received $505,000.00 in grants for Meadowbrook Park and that Ms. Seamon would need to go back through the records starting with 1999 to calculate the total dollar amount of township funds spent on Meadowbrook Park. Ms. Kristensen asked what a firewall was. Bruce Schermbeck explained what a fire wall was. Ms. Kristensen also asked for detailed records of legal fees spent for zoning cases over the past twelve years. After some discussion of Public Record Request, Ms. Rozak stated that the legal fees from the past six years were available on the current computer system and could be easily obtained for Ms. Kristensen.
Bruce Schermbeck stated that Mr. Scott had a very good point regarding zoning and he would not live in a community that did not have it. He stated the zoning should be enforced equally for the poor and the rich.
Loretta Grentzer asked about the stop sign at the intersection of State Route 269 and Bayshore Rd. Chief Mike Meisler stated that possibly a light needed to be installed at this intersection Ms. Rozak will contact the Ottawa County Engineers office in regards to what can be done.

Executive Session
Ms. Rozak moved to go into executive session at 9:01 p.m. to discuss property acquisition. Second by: Mr. Scott. Vote: Mr. Hirt-yes, Mr. Scott-yes, Ms. Rozak –yes. Motion carried

Ms. Rozak reconvened at 9:48 p.m.

Discussion on property acquisition will continue in executive session after the next regular meeting held on April 28th, 2010.

There being no further business the meeting was the meeting was adjourned at 9:48 p.m.
