The regular meeting of the Danbury Township Board of Trustees held April 23, 2008 was called to order by the President, Ms. Dianne M. Rozak with Ms. Rozak and Mr. David M. Hirt in attendance. Mr. John C. Englebeck was excused.
Visitors at the meeting were: Ted Kaznoch, Chris Timko-Grate, Tony Novak, Jim Dress, Mike Meisler, Matt Seamon, Rita Mahler and Loretta Grentzer.
Approve Minutes Minutes of the April 9, 2008 regular meeting were approved as submitted.
Correspondence The following correspondence was received: Thank you from Nathan Hartman for the Trustees resolution and participation in his Eagle Scout Court of Honor. Invitation from the Port Clinton Police Department to attend the 2008 Police Memorial services to be held May 22 at 11:00 a.m. at the Port Clinton Moose Lodge. Notice from the Ottawa County Commissioners of a hearing on revisions to the lodging excise tax. Meeting will be May 6 at 3:00 at the courthouse. February report of activity from the Ottawa County Sheriff’s Dept. Invitation from the Village of Marblehead to participate in the annual Memorial Day services to be held May 26. Notification that Detective Sgt. Mark Meisler was honored as a co-recipient of the Light of Hope Award by the Ottawa County Prosecutor’s Office, Victim Assistance Program and the Family and Child Abuse Prevention Center during the recent observance of National Crime Victims’ Rights Week. Also receiving the honor was Ottawa County Sheriff’s deputy Mark Nye.
Sign at Meadowbrook Ms. Rozak submitted a design drawing of the sign which is currently being prepared by the WSOS Quilter Sign shop. The sign is an acknowledgement of the grant funding received for the most recent Meadowbrook acquisition.
LED Stop Sign Chief Meisler stated he contacted the County Engineer about erecting an LED stop sign at the intersection of Danbury North and Bayshore Roads. The Engineer will need a written request from the Board to erect a sign at that location. Chief Meisler added it is his under-standing that if permission is given to erect the sign it will be the township’s responsibility to purchase, erect and maintain it.
Alternate Insurance Plan Following a presentation at the last meeting on an alternative insurance plan known as a Health Reimbursement Arrangement (HRA) Mrs. Sowers reported she learned that an Attorney General’s opinion issued last fall prohibits elected township officials from switching to an HRA mid-term unless the resolution authorizing health insurance benefits before taking office specifically included it. The Ohio Revised Code also specifies that insurance offered to township employees and officials must be uniform. A house bill has been submitted which would allow township officials to switch to this type of insurance plan but it is not certain how long it might be until it is adopted.
Leaf Recycling Trustees agreed to extend the drop off period for the spring leaf recycling program through the month of May.
BZA Resignation Mr. Hirt moved to accept with regret the resignation of David Van Auken from the Board of Zoning Appeals effective immediately. Second by Ms. Rozak. Vote: Mr. Hirt-yes; Ms. Rozak-yes. Motion carried.
BZA Appointments Ms. Rozak moved to appoint Loretta Grentzer to the Board of Zoning Appeals for the remainder of the term ending December 31, 2009. Second by Mr. Hirt. Vote: Mr. Hirt-yes; Ms. Rozak-yes. Motion carried.
Ms. Rozak moved to appoint John William Smith to the Board of Zoning Appeals for the full term ending December 31, 2012. Second by Mr. Hirt. Vote: Mr. Hirt-yes; Ms. Rozak-yes. Motion carried.
Mr. Hirt moved to appoint Dan Stein as an alternate to the Board of Zoning Appeals for the term ending December 31, 2012. Second by Ms. Rozak. Vote: Mr. Hirt-yes; Ms. Rozak-yes. Motion carried.
Authorize Purchase of Lightbars Chief Meisler submitted a quote from D.R. Ebel, Northwood, Ohio for six new Whelan LED lightbars at a cost of $1550.99 each or a total of $9,305.94. In discussion the Board noted there are two new cars on order and felt it would be beneficial to equip these vehicles with the newer light bars but questioned whether it was necessary to replace all of the lightbars at this time. Chief Meisler said the department is not in desperate need of replacing all of the bars now but felt it would look nice to have the same type of lightbars on all of the cruisers. The new bars are approximately ½ inch shorter than the current bars. The Chief added that the price per lightbar is slightly higher if only two bars are purchased. Ms. Rozak moved to purchase two Whelan LED lightbars from D.R. Ebel at a cost of $1599.99 each. Second by Mr. Hirt. Vote: Mr. Hirt-yes; Ms. Rozak-yes. Motion carried. Approve Payment of Bills After examining the following bills in the amount of $19,490.02, Mr. Hirt moved that they be accepted and warrants for the various amounts be drawn. Second by Ms. Rozak. Police Report Police report was submitted listing a total of 394 incidents handled during the month.
Zoning Report Zoning report was submitted listing a total of 15 permits issued during the month of April to date.
Comments/Concerns Ted Kaznoch expressed concern that so much money has been spent on parks and nothing has been done to build a new complex with a police station. He talked about the new facility in Russell Township where he said General Fund money was used to build the police station. Fiscal Officer Rhonda Botti Sowers said townships that do not contain a village with property owners who pay into the township’s general fund may use general fund money to support their police department. That is not the case in Danbury Township. In order to have a police department here the township trustees needed to create a district excluding the village of Marblehead. This police district is funded solely by levies approved and paid by property owners in the district. Ms. Rozak added that the county prosecutor is still researching the law to determine whether the trustees need to put the question of constructing a new township building on the ballot or not. Loretta Grentzer and Chris Grate felt the police department should have been allowed to replace all six of their lightbars. Mrs. Sowers explained that before the last Police levy was placed on the ballot, she, the Police Chief and the Trustees prepared cost projections to determine how long this levy could support the department before they would have to ask the taxpayers for additional funds. The budget estimates included money to pay for a new police station. She added that while some of these purchases may not seem extravagant, the Trustees would like to be able to afford a new police station and not have to go back to the voters any sooner than necessary. Matt Seamon asked if it would be possible to put a gate in the fence behind the ballfield backstop so players will not have to climb over the fence to retrieve foul balls. Mr. Dress said this can be done.
