The regular meeting of the Danbury Township Board of Trustees held September 14, 2011 at 7:00 p.m. was called to order by President Ms. Dianne M. Rozak, with Ms. Rozak, Mr. Charles B. Scott, and Mr. David M. Hirt in attendance. Also, present Fiscal Officer -Shelley Seamon, Police Chief- Mike Meisler, and Road Superintendent-Jim Dress.
Visitors in attendance were, Rita Mahler, Cheryl Harner, Gloria Rhyner, John Rhyner, Scott Kerik, Martin J. Smith, Jodi Kopanski, Lisa Bruno, and Mark Scagnetti.
Approve Minutes The minutes of the regular meeting held August 24, 2011 were approved as submitted.
Correspondence The township received the following correspondence:
An invitation to the farewell reception being held at the Ottawa County Fairgrounds on Wednesday, September 21, 2011 to honor Sheriff Robert Bratton for his years of service to Ottawa County.
Notification that the Ottawa Regional Planning Commission will hold its regular meeting on Tuesday, September 20, 2011 beginning at 7:30 p.m. in the Emergency Operations Center at the Ottawa County Courthouse. They will review the Steinbrick Subdivision, preliminary plat. The trustees should direct questions to Director, Todd Bickley before September 19, 2011. Dianne & David Wallace sent a letter thanking Detective Sergeant Mark Meisler for manner in which he helped them while looking for Sara. Notification of the next Ottawa County Township Association meeting will be held on Thursday October 27, 2011 and will be hosted by Salem Township. More details will follow.
Notification that the Ottawa County Citizens Corps Advisory Council will meet on Tuesday, September 27, 2011 at 6:00 p.m. at the Ottawa County EMA Offices in the basement of the Court House.
Roads, Buildings, and Grounds Mr. Scott reported that the maintenance staff had been busy mowing and grinding brush along the township roads ways. Furniture and fixtures were rearranged in the zoning office. Crack sealing machinery is ready and sealing will commence shortly. A list of public auction items is be compiled and ash tree logs removed from township property will be included in the auction.
Keeper’s House Update Mr. Scott reported that he attended the board meeting held at the Keeper’s House on Wednesday, September 7, 2011. Mr. Scott explained to the trustees the items he discussed, in which he assured board members attending that the trustees had not forgotten about the needed repairs.
Mr. Scott explained that his thought process was to determine what was causing the damage to the Keeper’s House, addressing that first and then making the needed repairs. Mr. Scott also said that he was researching the overall use of the property because there is no parking lot and he was exploring the idea of incorporating sign replacement into a plan since currently signage does exist. Mr. Scott stated that the board members in attendance agreed with him.
Mr. Scott reported that currently the maintenance staff was handling a bee problem at the Keeper’s House. Safe Routes to School Update Mr. Scott reported that ODOT has approved the installation of sidewalks in the road-right-of-way along the north side of State Route 163 and public meetings will be scheduled.
Police Police Chief Mike Meisler reported 558 incidents handled by his department in the month of August and 212 incidents had been handled to date in the month of September.
Chief Meisler asked the trustees when the private outdoor light was scheduled to be installed at the police station. Mr. Hirt said he would follow up with Jeff Schimd at Ohio Edison.
Fire Mr. Hirt reported that the LVFD handled 58 calls during the month of August and no run report was available for the MVFD.
Safety The trustees discussed that Spooner Inc., was interested in providing a quote for worker’s compensation to the township. Ms. Rozak reminded the trustees that it had not been determined yet if the township could participate in a group-rating program. The trustees agreed to obtain a quote from Spooner Inc. Safety Coordinator, Deborah Burley- Biro will contact the company regarding this matter. Zoning Ms. Rozak reviewed the following monthly reported detailing the activity handled by the zoning office during the month of August.
Danbury Township Zoning August 2011 Monthly Report Retirement Zoning inspector Rhonda Botti Sowers announced her retirement effective August 31, 2011. Mrs. Sowers served as zoning inspector for 13 years and was the zoning assistant for 8 years prior to that. She retires as Danbury’s longest serving inspector and the only woman to hold that position. Permits Twenty permit applications were processed in August and a total of $1186.35 collected in fees. Residential permits were issued for one new single-family home on Bailiwick Lane; three additions, two decks, one foundation under an existing home; one garage; one boat dock/walkway; four fences; and one change of use from a commercial to a residential structure. Commercial permits were issued for a mini-warehouse building and a fence. Two applications were rejected each resulting in an application for area variance. Board & Commission Activity The Board of Zoning Appeals held a hearing in August on the following application: #2011-101 area variance to a front setback for a porch denied A special meeting was held August 22 to approve the minutes of the regular meeting. The Zoning Commission continued a review of proposed amendments to the L district. Township Trustees accepted the resignation of Lloyd Dayton as an alternate member of the zoning commission. The Board of Trustees held a final hearing on revisions to the comprehensive Land Use Plan and adopted it with modifications on August 2nd. Calls and Site Visits A primary activity of the Zoning staff is responding to inquiries from residents, developers, appraisers, contractors, etc. Inspections are performed to verify or identify violations as well as to verify that projects are completed in compliance with approved plans. In addition, the department staff greets visitors seeking information regarding other township services and directs them to the appropriate official or department.
During the month of August 2011 the Department responded to 328 calls, e-mails and in-person inquiries and went on 12 site visits. Public Hearing Notice The Danbury Township Board of Zoning Appeals will hold a hearing at the Danbury Township Hall, 5972 E. Port Clinton Eastern Rd., Marblehead, OH 43440 on Wednesday, September 21, 2011 beginning at 6:30 p.m. on the following applications: #2011-120 by Jack Tibbels requesting an area variance on a corner lot to allow a front yard setback in one front yard of twenty (20) feet for the purpose of constructing a commercial boat storage building at 6965 E. Harbor Road in the “R-C” recreational-commercial district. The required setbacks for this corner lot are seventy (70) feet for one front yard and twenty-five (25) feet for the other. #2011-122 by Joseph and Virginia Armaro requesting an area variance to allow side and rear setbacks of two and a half (2.5) feet for the purpose of constructing a garage at 315 N. Channel Grove Rd. in the “R-3” high density residential district. The required setbacks for an accessory building are five (5) feet from both the side and rear.
Fiscal Report Fiscal Officer, Shelley Seamon presented the trustees with detailed reports regarding the financial status for the township as of September 14, 2011.
Ms. Seamon explained that the August 31, 2011 and September 14, 2011 payrolls were included in the payment of bills, which totaled $85,163.23. Ms. Seamon reported that she had met with Kevin McElligott of Midland Services, regarding providing a quote for insurance for the township. Ms. Seamon asked the board if they were interested in discussing the quote with Mr. McElligott. The trustees agreed it was a good idea to meet with Mr. McElligott. Ms. Seamon will notify the trustees once Mr. McElligott has the quote prepared.
Ms. Seamon reported that County Auditor, Jo Ellen Regal has agreed to meet with the fiscal officers two hours prior to the October 27, 2011 Ottawa County Township Association quarterly meeting being held at Salem Township, to discuss the negative long term effect of cuts to township funding. Ms. Seamon said she would be attending and trustees were welcome to attend as well.
Ms. Seamon reported that 2012 was the last year the township would receive estate tax revenue and the projection received from the County Auditor for Local Government funding in 2012 was $30,374.94, compared $43,266.06 in 2011. Committee reports concluded at 7:25 p.m. and department heads were dismissed.
ADA Renovation –Update for the Township Hall Scott Kerik, of Bodner & Kerik provided the trustees with detailed information regarding the quotations received to renovate the archway entrance at the township hall. Mr. Kerik and the trustees discussed the revised scope of work and the significant amount of pavement work needed to eliminate any step at the entrance. Because of the additional pavement, the revised estimate for the renovations was $32,000.00 versus the original estimate of $18,500.00. It was also discussed that the door for the entrance had to be custom ordered and delivery of the door was five weeks.
Contractors submitting quotes for project were R.J. Runge Company -$27,525.00, Williams Brothers Builders - $30,665.00 and D&G Focht Construction Company - $48,300.00. Because the lowest quote received was over $25,000.00, Mr. Scott provided information to the trustees that he had obtained, after consulting with County Prosecutor, Mark Mulligan regarding the new competitive bid rate. Mr. Scott said that Mr. Mulligan recommended that the board not accept the quote until the new competitive bid rate of $50,000.00 took effect on September 29, 2011.
The trustees agreed to consult with Mr. Mulligan regarding the matter and no action was taken.
Alternate Zoning Commission Members Ms. Rozak announced that at the special meeting held September 13, 2011, the trustees appointed Jim Jacobs and Jodi Kopanski to fill the two vacant alternate positions for the Danbury Township Zoning Commission.
Regional Planning Alternate The trustees agreed to offer Vito Kaminskas the position of alternate to the Regional Planning Commission. Ms. Rozak will contact Mr. Kaminskas.
Approve Zoning Inspector Job Description Mr. Hirt moved to approve the job description for the Danbury-Township Zoning Inspector as follows: Job Description DANBURY TOWNSHIP ZONING INSPECTOR Reports to: The Danbury Township Board of Trustees
Overview of Position: The Zoning Inspector shall administer and enforce the Zoning Resolution of Danbury Township.
Overview of Duties
1. Assist the public by providing information on all applicable zoning provisions and procedures and provide referrals to the proper agencies.
2. Perform plan review of residential and commercial construction project applications to determine compliance with applicable zoning provisions pursuant to the Danbury Township Zoning Resolution.
3. Issue zoning permits or denial notices for each complete application received.
4. Conduct field inspections for all new construction and changes of use.
5. Maintain complete and accurate record of all applications reviewed and inspections completed.
6. Discuss application procedures and review construction plans with builders, developers and general public.
7. Investigate possible zoning violations in response to public complaints or those observed while in the field.
8. Prepare violation notices and orders for any construction project or property found in violation of the Danbury Township Zoning Resolution.
9. Prepare materials as needed for prosecutor or other zoning attorneys as a result of summons, citations or warrants issued. Appear in court as complainant or witness as required.
10. Assist the Zoning Commission and Board of Zoning Appeals (BZA) as needed.
11. Responsible for the preparation and processing of all cases filed before the Zoning Commission and BZA to meet all legal requirements.
12. Maintain accurate records of all applications filed before the Zoning Commission and BZA.
13. Function as liaison between the Zoning Commission and the Board of Zoning Appeals. 14. Maintain daily log of calls, emails, inquiries, permits, inspections and violations. Prepare monthly report of departmental activity. 15. Keep zoning resolution current and ensure all updates are processed by Clearzoning®.
16. Respond to zoning-related public records requests. Knowledge, Skills & Abilities A. Understand basic residential and commercial/industrial construction practices including the ability to read and understand construction drawings, documents and site plans.
B. Possess strong organizational skills including the ability to prepare reports and organize files.
C. Ability to communicate effectively both verbally and in writing.
D. High degree of public relations skills including the ability to deal effectively with the public.
E. Understand and have knowledge of zoning laws and comprehensive plans including their formation, process of adoption and implementation.
F. Valid driver’s license and access to a properly insured vehicle.
Tools and Equipment Personal computer and word processing programs, internet and email, printers, copier, scanner, fax, telephone, calculator, digital camera, engineer and architect scales, laser measuring device and measuring wheel. Work Environment The duties of this job are performed inside a climate-controlled office setting and also on construction sites and at times in inclement weather.

Mr. Scott seconded the motion. All voted yes. Motion carried.
Compensation for the Secretary to the Township Zoning Boards Ms. Rozak reviewed how the BZA and DZC members are compensated and she recommended to the board that Ms. Biro be paid at her hourly rate instead of the standard rate of $15.00 per hearing attended or per meeting attended.
The trustees discussed Ms. Biro’s current hourly rate, the time in which it would take to prepare the minutes for the DZC and BZA and the number of hours Ms. Biro’s is currently working since she is part-time in which she does not receive benefits.
Ms. Seamon will research how many hours a part-time employees can work before the township is obligated to provide benefits to an employee and provide information to the board. Ms. Rozak moved and Mr. Hirt seconded to compensate Deborah Burley-Biro at her currently hourly rate $14.89 for secretarial duties to the DZC and BZA, which includes preparation of the minutes for both boards, instead of the standard rate of $15.00 per hearing attended or per meeting attended. The rate will be retroactive to the first meeting attended on September 7, 2011 for the Zoning Commission. All voted yes. Motion carried
Meadowbrook Trail Construction Ms. Rozak announced that the construction of the trails at Meadowbrook would commence on September 19, 2011. Fall Newsletter The trustees reviewed the content of the newsletter and agreed it should be printed and distributed. Reasonable Request for Residential ADA Issues Procedure Corrections Ms. Rozak explained that after the trustees had adopted the procedure on September 6, 2011, Mr. Hirt questioned if the trustees have the authority to grant the variance.
The trustees held a brief discussion regarding corrections to the Reasonable Request for Residential ADA Issues Procedure. The trustees did not make any changes to the Application Form to apply for the request.
Mr. Scott moved to approved that the procedure be corrected as follows:
Reasonable Request for Residential ADA Issues Procedure through Danbury Township Zoning
1. When it is determined after application to the township that the need for a reasonable accommodation exists, a variance application will not be required. The applicant must process an application for zoning certificate and the reasonable accommodation authorized shall be the minimum waiver required to address the existing need. Medical verification supporting the request for accommodation is required.
2. The Danbury Township Board of Trustees shall formally approve the reasonable accommodation request once medical verification is received and the reasonable accommodation form is completed. A zoning certificate will then be issued. This procedure shall occur at the earliest regularly scheduled township trustee meeting immediately following receipt of an application for Reasonable Request for Accommodation.
3. By signing the Reasonable Request for Accommodation form the applicant acknowledges the project will only be constructed on the property where the applicant resides and that no variance will permit any construction in the road-right-of-way.
4. Applicant is required to obtain an Ottawa County building permit prior to commencement of construction.
5. This procedure is in force only for residential ADA applications.
6. The effective date for this procedure is September 14, 2011.
Ms. Rozak seconded the motion. All voted yes. Motion carried.
Carbon Offset Birding Project for Meadowbrook Cheryl Harner of the Greater Mohican Audubon Society gave a presentation regarding a Carbon Offset Birding Project for Meadowbrook. Ms. Harner explained that the Ohio Ornithological Society and the Midwest Birding Symposium had collaborated to raise funds to purchase additional Meadowbrook property to be set aside for conversation purposes.
Ms. Harner announced that Meadowbrook was a destination for the upcoming Midwest Birding Symposium in Lakeside, September 15, 2011 through September 18, 2011.
Petition for Special Relief The trustees and fiscal officer discussed the Petition for Special Relief, which Time Warner Cable filed through the Federal Communications Commission to be relieved of paying the franchise fee to the participating township’s in the franchise area. No action was taken.
Set Trick or Treat Hours The trustees set trick or treat hours for Monday, October 31, 2011, from 6:00 p.m. to 8:00 p.m. to coincide with the Village of Marblehead’s hours.
Sign Cemetery Deed The trustees signed a cemetery deed for Richard K. England Sr., Lot 138, grave 1, in the 2nd addition at Sackett Cemetery.
Approve Travel & Meals Expenses Mr. Scott moved and Ms. Rozak seconded to approve meal and travels expenses for Officer’s Charles Cunningham and Brian Sloan while attending Street Survival training in Canfield, Ohio. All voted yes. Motion carried.
Approve Payment of Bills After examining the following bills in the amount of $85,163.23, Ms. Rozak moved and Mr. Hirt seconded that they be accepted and warrants for the various amounts be drawn. Line Item Transfers Mr. Hirt moved and Mr. Scott seconded to authorize line item transfers for the Police and Fire levy fund totaling $4,000.00. The breakdown down was as follows: $3,000.00 from line item # 2081-210-599-0000 to line item #2081-210-314-0000 and $1,000.00 from line item #2191-220-599-0000 to line item #2191-210-314-000, as recommended by Fiscal Officer, Shelley Seamon. Approve Payment to Bill’s Implement Ms. Rozak moved and Mr. Scott seconded to approve payment to Bill’s Implement Sales, in the amount of $421.86, for the purpose of purchasing a FS 130 Trimmer and supplies to be used in the cemetery/parks. Vote: Mr. Hirt abstained, Mr. Scott-yes, Ms. Rozak-yes. Motion carried.
Comments & Concerns During the Comment & Concern portion of the meeting, the following citizens interacted with the trustees, Rita Mahler, John Rhyner, Gloria Rhyner, and Lisa Bruno.
Concerns and comments voiced involved the dismal of department heads, the three-minute rule, and the extent of the police report. A variety of questions was addressed with regard to the appointment of the secretary for the zoning boards, a public request made to the zoning department, and how the zoning boards conduct their meetings.
Mr. Hirt provided an updated regarding the potential creation of a Fire District.

No action was taken. Ms. Rozak moved to adjourn the meeting at 10:08 p.m. Mr. Scott seconded the motion. All voted yes. Motion carried.
