The regular meeting of the Danbury Township Board of Trustees held August 10, 2011 at 7:00 p.m. was called to order by President Ms. Dianne M. Rozak, with Ms. Rozak, Mr. Charles B. Scott, and Mr. David M. Hirt in attendance. Also, present Fiscal Officer -Shelley Seamon, Police Chief- Mike Meisler, Road Superintendent-Jim Dress, and Zoning Inspector- Rhonda Botti Sowers.

Rita Mahler, Kathy Radabaugh, Matt Seamon, Henry Kihlken, Allison Holzaepfel, Sue Hartman, Nan Sauber, Tony Novak, and Jodi Kopanski.

Approve Minutes
The minutes of the regular meeting held July 27, 2011 were approved as submitted.
The minutes from the special meetings held on August 2, 2011 and August 4, 2011 were also approved as submitted.

Correspondence
The following correspondence was received:

The Ottawa County Sanitary Engineer’s Office will hold the 2nd informational meeting on Thursday August 25, 2011 at the Danbury Township Hall beginning at 6:30 p.m. regarding the sanitary sewer replacement project for Erie Beach Road and the Island View Subdivision.

An email was received from Carrie Herman, commending and thanking Detective Mark Meisler for the manner in which he had handled an incident two weeks ago.

Erin Steinbrick sent card thanking Patrolmen Brad LaMarca and Josh Young for their help and kindness when she was involved in an accident just over a month ago.

An informational letter was received from Judson M. Delancey, IV of the Ohio EPA, Division of Surface Water/Storm Water Program regarding the storm water construction located in Perryview Estates. The letter was addressed to Mr. Harold Schmardebeck

Roads, Buildings, and Grounds
Mr. Scott reported that the seasonal maintenance continued and the gate was installed at the brush drop-off site. A maintenance employee will open the gate Monday through Friday, with a police officer closing the gate at dusk; on weekends, a police officer will perform both opening and closing the gate.
Mistic Bay Blvd.
Mr. Scott reported that the road-resurfacing project for Mistic Bay Blvd., would take place in September; an exact date had not be determined.

Dog Park
Mr. Scott reported that the waterline, lawn hydrants, and parking area were installed for the dog park at 310 S. Bridge Road. Mr. Scott explained that there was an additional cost of $480.00 to purchase the backflow preventer and accessories for the waterline and because it was not included in the quote from Dave Shrock.

New HVAC System
Mr. Scott reported the new quotes to repair the air conditioning at the police station were being obtained based on the newest specifications received from the engineer. Mr. Scott also reported that Chief Mike Meisler was preparing a final checklist. Fritz Roberson of the Collaborative and Chief Meisler will do a final walk through of the building and then Mr. Roberson will prepare the paperwork to authorize final payments to the contractors.

Public Auction
A brief discussion was held regarding disposing of miscellaneous items and equipment the township no longer used or had to retain for evidence. Mr. Scott reported Mark Scagnetti was interested in conducting the auction. The trustees asked Mr. Dress and Chief Meisler to compile lists of the items in order that they can be declared a surplus and be disposed of. The date for the auction was set for Saturday, October 15, 2011 beginning at 11:00 a.m.

Police
Police Chief Mike Meisler reported that his department handled 734 incidents in the month of July compared to 578 in 2010 with 165 incidents handled to date in August.

Fire
Mr. Hirt reported that the LVFD handled 71 calls in July and the MVFD handled 59 calls.

Safety
Ms. Rozak reported that there was an excellent response to the request for the Citizens Emergency Response Team volunteers. Ms. Rozak stated that Safety Coordinator, Deborah Burley-Biro will follow-up with each respondent.

Zoning
Zoning Inspector, Rhonda Botti Sowers, reported 13 permits were issued to date in the month of July with 6 permits issued to date in August. Ms. Sowers gave an overview of the activity handled by her department in July. The report was as follows:

Permits
Thirteen permit applications were processed in July and a total of $586.72 collected in fees. Residential permits were issued for two new single-family homes, one on Harborview Drive and the other on Tecumseh Blvd.; two decks, one carport, one porch; four sheds; and one fence. One application was rejected resulting in an application for an area variance.
Board & Commission Activity
The Board of Zoning Appeals had no hearings during the month of July.
The Zoning Commission continued a review of proposed amendments to the L district. Township Trustees accepted with regret the resignation of Patricia Munn from the zoning commission and appointed alternate member Tim Sypherd to fill her unexpired term.

There were no zoning hearings before the Board of Trustees.
Calls and Site Visits
A primary activity of the Zoning staff is responding to inquiries from residents, developers, appraisers, contractors, etc. Inspections are performed to verify or identify violations as well as to verify that projects are completed in compliance with approved plans. In addition, the department staff greets visitors seeking information regarding other township services and directs them to the appropriate official or department.

Notice of a Public Hearing
The Danbury Township Board of Zoning Appeals will hold a hearing at the Danbury Township Hall, 5972 E. Port Clinton Eastern Rd., Marblehead, OH 43440 on Wednesday, August 17, 2011 beginning at 6:30 p.m. on the following application:

#2011-101 by Burl and Sharon Anderson requesting an area variance to allow a front yard setback in one front yard of nine (9) feet for the purpose of constructing a porch at 2119 Whitecaps Lane in the “R-3” high density residential district. This is a corner lot; the required minimum front setback is twenty-five (25) ft. on both sides of the lot adjacent to the road.

Resignation of Lloyd Dayton
Ms. Sowers explained that Lloyd Dayton had contacted her on Monday, August 8, 2011 and verbally resigned from the zoning commission board. Ms. Rozak moved and Mr. Scott seconded to accept with regret the resignation of Lloyd Dayton from the Danbury Township Zoning Commission effective August 31, 2011. Vote: Mr. Hirt-yes, Mr. Scott-yes, Ms. Rozak-yes. Motion carried.

Candidates for Zoning Boards
Ms. Sowers provided the trustees with a list of residents interested in serving on the zoning boards. Ms. Rozak will contact the individuals on the list.

Zoning Issue
A letter was received from Sharon Kobak regarding concerns that she has with the trustees and zoning department regarding the construction of a handicap ramp at her father’s home. Ms. Sowers provided information regarding this matter. The trustees discussed the information Mr. Scott received from Ash Lemons of the Ability Center of Greater Toledo who is the Director of Housing and Advocacy Services, regarding ADA compliance and authorized the zoning inspector to contact Mr. Lemons.

Fiscal Report
Fiscal Officer, Shelley Seamon presented the trustees with detailed reports regarding township finances as of August 10, 2011. Ms. Seamon advised that Kevin McElligott of Midland Services Agency, Inc. had not returned her call regarding the insurance packet she received.

Ms. Seamon acknowledged the receipt of two applications for the maintenance department.
Ms. Seamon explained that she had informed the each requestor that currently the township was not hiring, but she would inform the board that the applications were received.

The trustees then held a brief discussing clarifying that; Jim Dress was stepping down as
Road Superintendent to become a part-time employee and the trustees would be interviewing the maintenance employees for the Road Superintendent position. It was also discussed that the township would not be hiring additional staff for the maintenance department at this time.

Committee reports concluded at 7:45 p.m. and department heads were dismissed.

Nuisance Complaint Update
2105 S. Emerald Shores Drive-Owner David Matt
Ms. Rozak reported that the vacant lot located at 2105 S. Emerald Shores Drives, was mowed resolving the matter.
Content Value for the Police Station
Ms. Seamon reported that Becky Swisher, of the Hylant Group had reviewed the inventory list of the police department and the value placed for the office furniture/equipment, was limited to $13,640.00. Ms. Seamon explained the township had a $13,500.00 limit overall for computers and software overall was limited to $10,000.00. Ms. Seamon also explained the overall limit for miscellaneous equipment was $50,000.00. Ms. Seamon noted that Ms. Swisher recommended revisiting the miscellaneous equipment limit before the policy renewed in November.

Keeper’s House Sign Replacement
The trustees reviewed the sign proof submitted by Allure Signs aka Allure Advertising. The cost was quoted at $1,554.00, which included a doubled sided sign printed/laminated, hanging sign below to state hours of operation, installation of the existing posts with new sleeves/caps painted to match the door of the Keeper’s House. Discussion was tabled until all proofs, quotes are received, and the Keeper’s House committee is consulted for input.

Meadowbrook Paved/Boardwalk Trails
Ms. Rozak reminded the trustees that the pre-construction meeting would take place at the township hall on Thursday, August 11, 2011 beginning at 9:00 a.m. and bids would be opened on Thursdays, August 18, 2011 at 9:00 a.m. at the township hall as well and she would attend both meetings. Ms. Seamon advised that due to prior commitments, she was unable to attend either of the meetings and asked if sign in sheets were needed as well as if minutes would be taken. Ms. Rozak responded that she would keep track of who attended each of the meetings and Poggemeyer would provide information for both meetings. Mr. Hirt advised that he would not be attending either meeting because he would be working. Mr. Scott advised that he would be attending the meeting for the opening of the bids, but was unable to attend the pre-construction meeting.

Ms. Seamon advised the trustees that at the regular meeting of June 8, 2011, the probable construction costs for the grant-funded trails were approved at $194,000.00 and at the previous meeting; the costs estimate of July 7, 2011 had increased to $204,000.00. Ms. Seamon noted that the unencumbered balance between the Clean Ohio Trails Fund and the Recreational Trail Program grants was $202,504.55. Ms. Rozak responded that actual costs for the trails would not be known until bid openings took place and costs could come in lower than projected. Ms. Seamon and Ms. Rozak discussed several other costs for the project.

Testing Procedures
Mr. Scott reported that he would be meeting with a representative from the Ottawa County Community Corporation, on Thursday, August 11, 2011 at the township to discuss developing testing procedures for the maintenance employees who are interested in the position of Road Superintendent.



Safe Routes to School (SRTS) Grant
Allison Holzaepfel presented information regarding the ODOT grant-funded program titled Safe Routes to School. Ms. Holzaepfel explained that grant was reimbursable and required a team approach between the school and the community. Ms. Holzaepfel also informed the trustees that the grant could be used for infrastructure and non-infrastructure on state, village and township roads within a 2 miles radius of the school. Ms. Holzaepfel asked the trustees from their assistance in obtaining the grant to install sidewalks in order to encourage active transportation to and from school while insuring the safety of the students. A brief discussion was held regarding the development of a safe travel plan to see if the construction of sidewalks was feasible. Mr. Scott will contact the Ottawa County Engineers office to seek an opinion.

Ms. Rozak moved and Mr. Hirt seconded the adoption of the following resolution:

WHEREAS, The Marblehead Peninsula Boy Scout Troop 331 is celebrating its 75th anniversary, and

WHEREAS, The Danbury Township Board of Trustees are tremendously proud of this outstanding
service organization whose members are trustworthy, loyal, helpful, friendly, courteous, kind, obedient, cheerful, thrifty, brave, clean, and reverent; and

WHEREAS, The mission of the Boy Scouts of America is to prepare young people to make ethical an
moral choices throughout their lifetimes by instilling in them the values of the Scout Oath and Law; and

WHEREAS, Boy Scout Troop 331 has contributed greatly to the betterment of the Marblehead Peninsula:

THEREFORE BE IT RESOLVED that on this 10th day of August 2011 the Danbury Township Board of Trustees express gratitude to this organization for their commitment to building character and values in our youth.

The vote resulted as such: Mr. Hirt-yes, Mr. Scott-yes, Ms. Rozak-yes. Motion carried.


ADA Access to the Township Hall
The trustees held a discussion regarding that the entrance of the township hall having to be ADA compliant by the November 8, 2011 election. Mr. Scott explained the manner in which the archway entrance would be modified and that additional blacktop would be added to remove any step hazards at the entrance of the township hall. Bodner & Kerik Architects submitted the plans for these modifications, which is the architectural firm the township has already hired for the remodeling of the township hall. Preliminary costs for the entranceway modifications were$18,500.00. Mr. Scott reported that with the addition of the blacktop at the entrance of the township hall; the architectural firm projected the additional cost to be $3,000.00 to $4,000.00. Being that the ADA access was mandatory and the total cost of the project was under the threshold for competitive bidding; the following action was taken.

Mr. Hirt moved and Mr. Scott seconded to authorize Bodner & Kerik Architects to secure three quotations for the mandatory ADA remodeling at the township hall with the stipulation that the project is completed by the November 8, 2011 election. Vote: Mr. Hirt-yes, Mr. Scott-yes, Ms. Rozak-yes. Motion carried.
Designate Depository
Mr. Scott moved and Ms. Rozak seconded to designate the Marblehead Bank as the depository for active and interim funds for the period from August 24, 2011 to August 23, 2016.

July Financial Reports and Bank Reconciliation
Ms. Rozak moved and Mr. Hirt seconded to approve the July financial reports and bank reconciliation. Vote: Mr. Hirt-yes, Mr. Scott-yes, Ms. Rozak-yes. Motion carried.

Comments & Concerns
Loretta Grentzer announced that candidate’s night was being held Thursday, October 13, 2011 at the Elks Club in Port Clinton, Ohio and invitations will be sent.

Ms. Grentzer advised that she was concerned that there were no waste cans to dispose of dog droppings at Meadowbrook Park. Ms. Rozak responded that doggy waste receptacles were being built and bags for the waste will be provided. Ms. Rozak informed Ms. Grentzer that the waste receptacles would be placed at Meadowbrook and Lake Point Park as well as at the newly created dog park.

With regard to the dog park, Rita Mahler asked what the additional of $480.00 was for and why the maintenance staff was at the dog park site doing the trenching. Ms. Rozak explained that the cost of $480.00 was to purchase the backflow preventer, which was required by the Ottawa County Sanitary Engineers Office, but was not a part of the quote Mr. Shrock submitted. Ms. Rozak also explained that Mr. Dress had agreed to do the trenching for the waterline. Mrs. Mahler also asked if the maintenance staff’s hourly wages to trench and run the waterline would be included in the total cost of the dog park. Ms. Rozak responded that they would not and explained why.

Mrs. Mahler explained that she had spoken to Scott Kerik regarding the remodeling of the archway entrance at the township, and she felt the approach being taken would make a big difference and still look the same. Mrs. Mahler stated that she appreciated that.

Tony Novak asked for the trustee’s assistance in having a pine tree that is uprooting on his neighbor’s property removed because he is concerned that eventually it will collapse on his home.Mr. Novak advised the trustees that he had contacted the property owner and nothing had came of his efforts to resolve the matter. It was discussed that the trustee’s cannot mandate situations on private property. Ms. Rozak will look at the tree and contact the homeowner regarding Mr. Novak’s concerns in the matter.

Ms. Rozak moved and Mr. Scott seconded to adjourn at 8:45 p.m., being there was no further business. Vote: Mr. Scott-yes, Ms. Rozak-yes. Motion carried.
