The special meeting of the Danbury Township Board of Trustees held August 2, 2011 at 6:30 p.m. was called to order by President Ms. Dianne M. Rozak, with Ms. Rozak, Mr. Charles B. Scott and Mr. David M. Hirt in attendance. Also, present Fiscal Officer -Shelley Seamon.

Visitors in attendance were, Dave Zielinski, Jim Pecl, Becky Price, Ron Knopf, Tim Gorman, June Galvin, John Englebeck, Jodi Kopanski, Mike Griffith, John Resetar, Rita Mahler, Lisa Bruno, and Allison Holzaepfel.

The purpose of the meeting was to finalize the 2011-2017 Land Use Plan for Danbury Township. Ms. Rozak stated the delay in adopting the new plan was because the board had decided to wait for 2010 census results so that they could be included. Ms. Rozak also stated that the board had asked the Zoning Commission to review the Land Use Plan committee’s recommended changes to the R-C district.

Ms. Rozak read the following excerpt taken from the April 26, 2011 Zoning Commission minutes. “ Mr. Sypherd commented that the purpose for reviewing the uses in the R-C district was because the Land Use Plan committee recommended additional areas along North Shore Blvd. for zoning which was a concern to residents in that area. Mr. Steinbrick added that if the Township Trustees do not adopt the change in the Land Use Plan there is not an issue. It was agreed that while there are some small zoning changes which need to be considered the overall list of uses in the R-C district is appropriate.”

Ms. Rozak read the correspondence received from Daniel English and Tim Gorman, who oppose the recommended change in the new plan and Tony Kopanski, who favors the change.

A discussion was held regarding the Land Use Plan committee’s recommendation to change the area on the south side of Northshore Blvd. from the west line of Lighthouse Bluffs subdivision to the east side of Perryview Drive to “recreational commercial”. Those opposed were concerned about property values decreasing, what types of business would be built, the increase of traffic and noise that would be generated.

Several visitors in attendance questioned who served on the Land Use Plan committee, did any of the members own property in the area recommended for change, and if minutes from the meetings were available. It was discussed that the committee had 16 members and 10 regularly attended. Two committee members did own property in the area recommended for change. Regarding the minutes, Ms. Rozak explained that minutes were taken.

Jodi Kopanski acknowledged that she was on the committee and did own property in the area recommended for change. Ms. Kopanski also explained the reasons why she felt this change would be beneficial to the community, one being the creations of jobs.

It was discussed that the Land Use Plan is a guide for development and is used by the township trustees to refer to once a property owner has requested to rezone their property. Ms. Rozak clarified the procedure that is followed to rezone property. It was also discussed that a decision made by the board can be overturned by filing a referendum and placing the issue on the ballot. It was noted that this had happen five times and each time the decision of the board was overturned.

Discussion concluded and the following action was taken.


RESOLUTION NO. 2011-005
ADOPTION OF THE DANBURY TOWNSHIP LAND USE PLAN

It was moved by Ms. Rozak and seconded by Mr. Hirt that the following resolution be adopted:

WHEREAS, the Ottawa Regional Planning Commission prepared and adopted Volume 2, Regional Development Plan in November of 1971 in accordance with Section 713.23 of the Ohio Revised Code, and

WHEREAS, the Ottawa County Commissioners by resolution on the 22nd day of November, 1971 adopted Volume 2, Regional Development Plan in accordance with Section 713.25 of the Ohio Revised Code, and

WHEREAS, a Land Use Plan for Danbury Township was adopted by the Danbury Township Trustees in 1985 and revised in 1996 and 2003 as an amendment to Volume 2, Regional Development Plan for the Danbury Township area of Ottawa County, and



WHEREAS, the Danbury Township Trustees appointed a Land Use Committee to revise said Plan in 2010, and

WHEREAS the revised plan was presented at public meetings on October 4, 2010, November 10, 2010, and August 2, 2011 with comments of those in attendance recorded and reviewed by the Danbury Township Trustees,

WHEREAS, as a result of the public hearings, the Danbury Township Trustees decided to make the following modification to the revised plan:

• Eliminate the recommendation that a new area on the south side of North Shore Boulevard from the west line of the Lighthouse Bluffs subdivision to the east side of Perryview Drive be designated recreational commercial

• Include updated 2010 census data.

NOW THEREFORE BE IT RESOLVED by the Danbury Township Trustees that the Danbury Land Use Plan, 2011-2017 is hereby adopted and is to serve as a supplement to Volume 2, Regional Development Plan as provided by Section 713.25 of the Ohio Revised Code and shall take precedence over previous land use recommendations for the Danbury Township area.

Vote on the motion resulted as follows: Mr. Hirt – yes; Mr. Scott- yes; Ms. Rozak- yes. Motion carried.

Ms. Rozak moved and Mr. Scott seconded to adjourn at 8:00 p.m., being there was no further business. Vote: Mr. Hirt-yes, Mr. Scott-yes, Ms. Rozak-yes. Motion carried.
