The regular meeting of the Danbury Township Board of Trustees held October 14, 2009 was called to order by the President, Ms. Dianne M. Rozak with Ms. Rozak, Mr. John C. Englebeck and Mr. David M. Hirt in attendance. Also present were Fiscal Officer Rhonda Botti Sowers, Road Supt. Jim Dress and Police Chief Mike Meisler.
Visitors at the meeting were Rita Mahler, Tony Novak, Matt Seamon and Shelley Seamon.
Approve Minutes Minutes of the September 23 special, zoning and regular meetings as well as the September 29 and October 6 special meetings were approved as submitted.
Correspondence The following correspondence was received: A letter from First Energy regarding information about aggregated buying groups who select electric suppliers. Ms. Rozak will contact First Energy for further information.
Committee Reports Roads, Buildings and Grounds Road Superintendent Jim Dress reported the fall clean-up went well, the parking lot at Meadowbrook has been stoned and his department is back to the task of crack sealing roads. Police and Fire Chief Mike Meisler reported 382 incidents handled by his department during the month of September and 157 incidents during the month of October to date.
Safety Ms. Rozak presented an update of activity prepared by Safety Coordinator Deb Burley-Biro. She also reported that all required reports for the BWC PDP+ and Drug Free Workplace programs have been filed. These reports show the progress made on the township's safety program which will result in a 17% reduction in workers' comp premiums in 2010. Ms. Biro also submitted a list of items which still need attention including development of a series of procedures and policies as well as an analysis of costs associated with safety/ accident prevention. Trustees will review the Safety Coordinator's recommendations regarding flu season and the current sick leave policy.
Zoning Zoning Permits Zoning Inspector Rhonda Botti Sowers reported 10 permits processed during the month of September and 2 permits for the month of October to date.
BZA Hearing The Board of Zoning Appeals will hold a hearing beginning at 6:30 p.m. Wednesday, October 21, 2009 on application #102-08 by Michael Prosser, agent for Harbor Bay Estates, Soccerman Ltd. and Louisville Title Agency requesting a conditional use for a 160 unit condominium development on lots 41A, 52 and 53 of Harbor Bay Estates, proposed Plat IV a total of 22.464 acres in the "R-C" Recreational-Commercial district.
Meadowbrook Shelter House The board received an estimate for construction of a stone patio and fire pit in lieu of a covered shelter house at Meadowbrook but is awaiting a response from ODNR to see if the NatureWorks grant funded project can be amended for this purpose.
Phase 2 Trail Excavating for the Meadowbrook Phase 2 paved bike trail has begun. The township maintenance department will install barriers at the Bayshore Road entrance to this trail to prevent access by motor vehicles. The barrier will be designed to accommodate emergency vehicles. Parking for Fishing Area Trustees have been unsuccessful in their attempts to find another location for a small parking area near the dike at Meadowbrook and will now explore what steps need to be taken to deposit fill in a floodplain in order to create a small parking lot near the fishing area.
Paving for Handicapped Parking and ADA Access The Board received a quote from KF Ventures in the amount of $7,758.00 for the cost of paving two handicapped parking spaces in the parking lot at Meadowbrook as well as paving an ADA accessible path that would connect from the parking lot to the paved trail. Ms. Rozak has contacted ODNR to see if it would be possible to include this paving in the grant project since the trail paving cost was far below the engineer's estimate and the approved grant award. Anticipating that the Board will have a response from ODNR regarding this request within the next day, Trustees set a special meeting for noon on Friday, October 16, 2009 to make a decision on the additional paving.
Boardwalk Ms. Rozak announced there are some issues which have arisen regarding the recently constructed boardwalk at Meadowbrook. Trustees are awaiting an inspection by the Building Dept. before deciding what additional steps to take.
Recreational Trails Grant Trustees received notification that their application for a Recreational Trails Grant was not approved in the most recent round of awards. Of 53 applications, 23 were funded. Application deadline for the next round of funding will be February 1, 2010. Ms. Rozak agreed to research other grants which might be available for this trail project before the Board decides whether to re-apply for the Recreational Trails Grant. Brush on Barnholt Property Ms. Rozak reported that she was contacted by Gudrun Barnholt, owner of vacant land east of the East Harbor Road/ North Shore Blvd. intersection following receipt of the Board's offer to clear back brush in an attempt to improve visibility. Mrs. Barnholt agreed to allow the township to clear the brush from her property.
Erie Beach Road Crosswalk Mr. Hirt reported that he had consulted with County Prosecutor Mark Mulligan about preparing an agreement that would authorize the Lakeside Association to stripe and maintain a crosswalk across Erie Beach Road leading from the Otterbein North Shore Retirement Center to Lakeside's entrance. After looking into specific requirements as well as determining that a crosswalk would not make it legal for golf cart travel across a public road the prosecutor recommended against the township taking on the liability of having a crosswalk striped on a township road. Trustees concurred with this recommendation and will notify the Lakeside Association of their decision.
Police Fund Appropriations for Operating Supplies As a follow up to discussion at the last meeting, Fiscal Officer Rhonda Sowers advised the Board that the $1500.00 line item appropriation for uniforms for the Police Chief has been depleted and the appropriation for operating supplies is down to a $2450.14. Chief Meisler said the only uniform item he plans to replace is his duty coat and said an additional $400 would be sufficient. The Board noted there is an unexpended amount in the motor vehicle appropriation that could be reallocated. Supplemental appropriations will be prepared for approval at the next meeting.
Make A Difference Day Ms. Rozak reminded that the Port Clinton Kiwanis members will be cleaning at Meadowbrook on October 24 for Make A Difference Day. Mr. Dress will be meeting with a Kiwanis representative to provide gloves and garbage bags for the workers and answer any questions they might have in preparing for the project.
Clearzoning Mr. Hirt moved to enter into an agreement with Clearzoning for consulting services on an as-needed basis at an hourly rate of $98 per hour for zoning code consultation and $77 per hour for the services of a graphics technician. Second by Mr. Englebeck. Vote: Mr. Hirt-yes; Mr. Englebeck-yes; Ms. Rozak-yes. Motion carried.
Set Trick-or-Treat Hours Trustees set Trick or Treat for Saturday, October 31, 2009 from 6:00 to 8:00 p.m. to correspond with hours set in the Village of Marblehead.
Approve September Financial Reports Mr. Hirt moved to approve September financial reports as submitted by the Fiscal Officer. Second by Mr. Englebeck. Vote: Mr. Hirt-yes; Mr. Englebeck-yes; Ms. Rozak-yes. Motion carried.
Approve Payment of Bills After examining the following bills in the amount of $ 29,357.62, Mr. Englebeck moved that they be accepted and warrants for the various amounts be drawn. Second by Mr. Hirt.
