The regular meeting of the Danbury Township Board of Trustees held January 9, 2008 was called to order by the President, Ms. Dianne M. Rozak with Ms. Rozak, Mr. John C. Englebeck and Mr. David M. Hirt in attendance.

Visitors at the meeting were: Chris Grate, Barbara McCall, Ben Monroe, Ruby Monroe, Jim Dress, Mike Meisler, Ted Kaznoch, Larry Dress, Tony Novak and Roland Stucky.

Approve Minutes
Minutes of the December 26 regular meeting and January 4 organizational meeting were approved as submitted.

Correspondence
Notice that the next meeting of the Ottawa County Township Association will be January 24, hosted by Allen Township. Program speakers will present information on grants.
Information from Lightle Enterprises of Franklin, Ohio about traffic safety products it offers. Information was also provided about a new product line which utilizes 100% recycled tire rubber and qualifies for grant funding through the Ohio Dept. of Natural Resources, Division of Recycling & Litter Prevention.
Copies of a brochure prepared by a group of Ottawa County officials, individuals from the private sector and representatives of social service agencies containing information for foreclosure prevention.
Notice from Time Warner Cable of programmer agreements that are set to expire. Notification is required by law even though the majority of the agreements will be renewed without any disruption in service.

Ohio Historical Society
Ms. Rozak reported that one requirement of a recent Coastal Management grant application was to notify the Ohio Historical Society of the proposed project. As a result, the Board received a letter from the State Society recommending the project area be surveyed to identify any historic sites. Included with the letter was a list of consultants capable of doing this type of work.
Discussion followed on whether a survey is mandatory or merely recommended. Ms. Rozak agreed to obtain additional information.

Letter of Support
Trustees received an opinion from the County Prosecutor advising a letter of support to be submitted with Tim Burns’, MC Ltd. Construction Services, application for Housing Trust Grant Funds from the Ohio Housing Finance Agency would not commit the township in any other way.
Based on the approval given at the last meeting Ms. Rozak reported she had sent a letter of support on behalf of the Board.

Removal of structures on Meadowbrook property
Ms. Rozak read a proposed ad seeking quotes for the demolition of the house on the portion of Meadowbrook property purchased from Betty Todd. Trustees agreed to publish the ad one time each in the Port Clinton News Herald and The Peninsula News.

AFLAC Supplemental Insurance
Fiscal Officer Rhonda Botti Sowers reported she had consulted with the County Prosecutor regarding whether AFLAC supplemental insurance may be offered as a fringe benefit to township employees but they are awaiting additional information before a decision can be made.

EPA Open Burning
Ms. Rozak reported contacting Tom Sattler of the Ohio EPA on January 3 to find out what role, if any, the township has in enforcing EPA open burning rules. She learned that while the township may adopt the rules for enforcement it is not mandatory. If the township chooses not to adopt the rules, the EPA will enforce them.
A lengthy discussion followed during which Township Fire Prevention Officer Roland Stucky explained the difference between EPA and State Fire Marshal regulations on open burning.

Volunteer Firefighters' Dependents Fund
Trustees received a response from County Prosecutor Mark Mulligan advising that two Trustees may serve on the LVFD board for the State Volunteer Fire Fighters' Dependents Fund but it will be considered a public body subject to open meeting requirements.
Mr. Hirt moved that he and Ms. Rozak serve a one-year term on the LVFD State Volunteer Fire Fighters’ Dependents Fund Board. Second by Mr. Englebeck. Vote: Mr. Englebeck-yes; Mr. Hirt-yes; Ms. Rozak-yes. Motion carried.
The Board will meet at 6:45 on January 23, 2008 at the Township Hall to organize for the year.
RESOLUTION TO APPLY FOR NATUREWORKS
PARKS AND RECREATION GRANT

Mr. Hirt moved adoption of the following:

WHEREAS, the State of Ohio through the Ohio Department of Natural Resources,
administers financial assistance for public recreation purposes through the Federal Land and Water Conservation Fund Program and/or the State of Ohio Natureworks Program, and

WHEREAS, the Danbury Township Board of Trustees desires financial assistance
under the Natureworks Program;

NOW, THEREFORE, be it resolved by the Danbury Township Board of Trustees

That the Danbury Township Board of Trustees approves filing an application for
financial assistance.

That Dianne M. Rozak is hereby authorized and directed to execute and file an
application with the Ohio Department of Natural Resources and to provide all information and documentation required to become eligible for possible funding
assistance.

That the Danbury Township Board of Trustees does agree to obligate the funds
required to satisfactorily complete the proposed project and become eligible for
reimbursement under the terms of the Natureworks Program.

Second by Mr. Englebeck. Vote: Mr. Englebeck-yes; Mr. Hirt-yes; Ms. Rozak-yes. Motion carried.

Mr. Hirt moved adoption of the following:

administers financial assistance for public recreation purposes through the Federal Land and Water Conservation Fund Program and/or the State of Ohio Natureworks Program, and

WHEREAS, the Danbury Township Board of Trustees desires financial assistance
under the Federal Land and Water Conservation Program;

NOW, THEREFORE, be it resolved by the Danbury Township Board of Trustees

That the Danbury Township Board of Trustees approves filing an application for
financial assistance.

That Dianne M. Rozak is hereby authorized and directed to execute and file an
application with the Ohio Department of Natural Resources and to provide all
information and documentation required to become eligible for possible funding
assistance.

That the Danbury Township Board of Trustees does agree to obligate the funds
required to satisfactorily complete the proposed project and become eligible for
reimbursement under the terms of the Federal Land and Water Conservation
Program.

WHEREAS, the Danbury Township Board of Trustees desires financial assistance
under the Recreational Trails Fund Program

NOW, THEREFORE, be it resolved by the Danbury Township Board of Trustees

That the Danbury Township Board of Trustees approves filing an application for
financial assistance.

That Dianne M. Rozak is hereby authorized and directed to execute and file an
application with the Ohio Department of Natural Resources and to provide all
information and documentation required to become eligible for possible funding
assistance.

That the Danbury Township Board of Trustees does agree to obligate the funds
required to satisfactorily complete the proposed project and become eligible for
reimbursement under the terms of the Recreational Trails Fund Program.

Authorize Transfer from STAR Ohio to Checking
Ms. Rozak moved to transfer $100,000.00 from STAR Ohio investment to checking. Second by Mr. Englebeck. Vote: Mr. Englebeck-yes; Mr. Hirt-yes; Ms. Rozak-yes. Motion carried.

Approve December Financial Report
Mr. Englebeck moved to approve the December financial report as submitted by the Fiscal Officer. Second by Mr. Hirt. Vote: Mr. Englebeck-yes; Mr. Hirt-yes; Ms. Rozak-yes. Motion carried.

Approve Payment to Luckey Farmers
Ms. Rozak moved to approve payment of check no. 32339 to Luckey Farmers, Inc. in the amount of $4,287.13 for gas and diesel. Second by Mr. Hirt. Vote: Mr. Hirt-yes; Ms. Rozak-yes. Motion carried. Mr. Englebeck abstained.

Water at Sackett Cemetery
Ms. Rozak reported she has been asked if it would be possible to provide a water source at Sackett Cemetery for people to use for watering flowers. Mr. Englebeck said St. Joseph’s cemetery has a large tank which they make available for this purpose.
Mr. Dress said he has a tank which might work for this purpose.

Crack Sealing Machine
Mr. Dress provided the Board with a quote to purchase a new crack sealing machine. He stated the one which his department used this past fall worked very well and he feels it would be worthwhile to purchase one for the township. The Board agreed and will make sure sufficient funds are appropriated for this purpose when the annual appropriations resolution is prepared.

Police Report
Police report was submitted listing 270 incidents handled during the month of December.

BZA Hearings
The Board of Zoning Appeals will hold hearings Wednesday, January 16, 2008 on the following applications: #217-07 by Port Lawrence Title, Trustee and John and Phyllis Tharp requesting a conditional use for a condominium development on Lot 21 A of Harbor Bay Estates, Plat II in the “R-C” Recreational-Commercial district; and #218-07 by Lakeshore Development LLC, agent for Janet Akosi, executrix of the estate of Paul Hnatiak, Jr. requesting a conditional use for a condominium development at 9886 E. Bayshore Rd. in the “R-C” Recreational-Commercial district.

Zoning Report
Zoning reports were submitted listing a total of 2 permits issued during the month of December and 4 permits for the month of January to date.

Annual Zoning report was submitted listing a total of 218 permits issued in 2007.

Comments/Concerns
Barbara McCall expressed concern about the condition of property adjacent to her at 1760 Marblewood. She asked if something can be done to make sure the grass gets cut this year.

Ruby and Ben Monroe had questions about their property on Meter Road and wondered why, if they remove one of the two homes from the property they can’t replace it. Zoning Inspector Rhonda Sowers explained the zoning resolution no longer permits two homes to be located on the same property.

Ted Kaznoch expressed displeasure that the Trustees are wasting money on Meadowbrook which he feels will only benefit tourists, not residents.

Larry Dress asked if the Trustees are going to accept leaves at the Brush Recycling center. Ms. Rozak again stated the township is not licensed through the EPA to accept leaves.

Executive Session
Ms. Rozak moved to go into executive session at 8:30 p.m. to discuss land acquisition and to discuss compensation of public employees. Second by Mr. Hirt. Vote: Mr. Englebeck-yes; Mr. Hirt-yes; Ms. Rozak-yes. Motion carried.

Ms. Rozak reconvened the meeting at 9:22 p.m.

Pay Increase for Seasonal Employee
Ms. Rozak moved to increase the pay for seasonal employee Marion Grate to $12.00 per hour. Second by Mr. Hirt. Vote: Mr. Englebeck-yes; Mr. Hirt-yes; Ms. Rozak-yes. Motion carried.

Decline Offer to Purchase Property
Trustees received an offer to purchase property at 360 Bridge Road from James and Janis Barth.
Mr. Hirt moved to decline an offer to purchase property at 360 Bridge Road from James and Janis Barth. Second by Mr. Englebeck. Vote: Mr. Englebeck-yes; Mr. Hirt-yes; Ms. Rozak-yes. Motion carried.
