President Ms. Dianne M. Rozak called the November 22, 2011 regular meeting to order at 7:00 p.m., with Ms. Rozak, Mr. Charles B. Scott, and Mr. David M. Hirt in attendance. Also, present Fiscal Officer -Shelley Seamon, Police Chief- Mike Meisler, Road Superintendent-Jim Dress and Zoning Inspector-Kathryn Dale.
Visitors attending were, John W. Smith, Rita Mahler, Peter Corrado, Jodi Kopanski, and Mark Scagnetti. Approve Minutes The minutes of the regular meeting held November 9, 2011 were approved as submitted.
Correspondence The following correspondence was received and read:
Todd Bickley Director of the Ottawa County Regional Planning Commission sent notification to Tim Sypherd regarding that the Regional Planning Commission met November 15, 2011 and reviewed the text amendments initiated by the Danbury Township Zoning Commission; recommending approval as presented.
Roads, Buildings, Grounds Mr. Scott reported that crack sealing continued and special attention was being given to Northshore Boulevard to prepare for the winter season. Bermming of Township roads has begun and from Church Road to the west has been completed. The cemetery was trimmed and mowed for the last time this year until spring. The maintenance staff attended a “Beet Juice” seminar at Catawba Island Township to further enhance their understanding of the road salt additive. Grinding quotes are being obtained and will be presented to the Board at the next regular meeting. The restrooms at Lake Point Park were pumped and demolition will occur this week.
278 N. Sackett Road Road Superintendent, Jim Dress reported that he had observed the placement of the boat at 278 N. Sackett Road. Mr. Dress said that the boat did not present visibility issues. The Trustees and Chief Mike Meisler discussed Incident Report # 11-275 filed with the Danbury Township Police Department on November 21, 2011, in which the Officer determined that the boat was not a visual obstruction. The report also stated that a second opinion was obtained and the result was the same. Culvert Replacement at Lake Point Park Ms. Rozak reported that she had contacted John Bidinger at ODOT and obtained the estimate for the culvert replacement at Lake Point Park. The preliminary estimate for this project was $73,710.55, which included a 25% contingency. Ms. Rozak said that ODOT would not be incurring any of the cost for the replacement. Ms. Rozak informed the Trustees that Brian Lucas had asked her to attend a meeting with him and John McDonald regarding the culvert replacement, because previously the Trustees discussed the possibility of splitting the cost evenly between, the Township, the Village of Marblehead as well as Lafarge. Ms. Rozak asked if Jim Dress and Brett Waldron wanted to attend as well. Mr. Dress said that he was interested in attending also. Mr. Scott asked why he had not been contacted since he was the Trustee that oversees the road department. Mr. Scott informed the Trustees that he had spoken with Brian Lucas a couple of times as well regarding the culvert replacement project. Ms. Rozak said she was not aware of that and she would inform Mr. Lucas that Mr. Scott as well as Jim Dress and Brett Waldron would attend. Ms. Rozak said she would notify Mr. Dress once a date was determined. Ms. Rozak reported that Mr. Bidinger said that all costs associated with repairing the Sea Wall that the Township maintains would be incurred by ODOT.
Police Police Chief Mike Meisler presented the trustees with the LCR Summary, which listed 224 incidents handled by the Danbury Township Police Department as of November 22, 2011. Mr. Hirt reviewed the LCR Summary, which included the following top ten incidents handled to date thru November 22, 2011: • 26-Assist other Danbury Unit • 15-Verbal Traffic Warnings • 11-Supplemental Reports • 10-Suspicisious Persons/Vehicles • 9-House Watch Request • 8-Theft By Unlawful Taking or Disposition Complaint • 8-Assist Marblehead Ambulance • 7-Assist Lakeside Ambulance • 7-Public Service • 6-Lockout/Car
Shredding Service Update Chief Mike Meisler reported that the shredding service was very popular and about seven residents utilized the service over the past two weeks. Chief Meisler informed the Trustees that the totes as well as the office cabinet were almost full.
2011 Ford Crown Victoria Chief Mike Meisler and the Trustees discussed the potential purchase of a 2011 Crown Vic from Sharpnack Ford Inc. Chief Meisler said he was not looking for another new car, but he felt this deal was too good to pass up especially since Ford will no longer be manufacturing the Crown Vic. Chief Meisler explained that Sharpnack Ford Inc., offered $7,000.00 for the 2008 backup Crown Vic, which previously Port Clinton Ford offered $4,000.00. Chief Meisler also explained that Sharpnack Ford would also take the 2006 Crown Vic in on trade as well and offered $4,800.00. The purchase price of the 2011 Crown Vic was $22,800.00 minus trading both cars plus a $15.00 titling fee, the department would pay $11,015.00. Chief Meisler explained that the backup car was only used for training a couple of times and otherwise it remained in storage. Chief Meisler recommended that the Trustees authorize the purchase and allow the 2006 and 2008 Crown Vic be traded to Sharpnack Ford to purchase a 2011 Crown Vic. Fiscal Officer, Shelley Seamon said that the funds were available for the purchase, but the Trustees would need to authorize a line item transfer of $11,000.00 from line item 2081-760-740-0000-Machinery, Equipment, & Furniture to line item 2081-760-750-0000-Motor Vehicle for the purchase. Authorize New Cruiser Purchase Ms. Rozak moved to authorize Chief Meisler to trade in the 2006 Crown Vic as well as the 2008 Crown Vic to purchase a 2011 Crown Vic from Sharpnack Ford at a cost of $11,015.00. Mr. Hirt seconded the motion. All voted yes. Motion carried. Authorize Line Item Fund Transfer – Police District Ms. Rozak moved to authorize the transfer of $11,000.00 from Machinery, Equipment, & Furniture line item 2081-760-740-0000 to the Motor Vehicle line item 2081-760-750-0000. Mr. Scott seconded the motion. All voted yes. Motion carried.
Intersection of SR 269 & Port Clinton Eastern Road Ms. Rozak reported that she had contacted Michael Stormer at ODOT and he said that ODOT would conduct an intersection study at SR-269 and Port Clinton Eastern Road (CR-5) to help determine the situation. Ms. Rozak said that Mr. Stormer expected the study to be completed by the end of December. Mr. Scott reported that he had sent a letter to County Engineer David Brunkhorst, requesting if the Township could install yellow LED flashing “Cross Traffic Does Not Stop” signs both east and westbound on Port Clinton Eastern Road, on the existing stop signs. Mr. Scott read the letter dated November 21, 2011, in which County Engineer David Brunkhorst acknowledged the Township’s requests for the installation of the signs at the above referenced intersection. Mr. Brunkhorst stated in his response that, “In accordance with your request and with the stipulations by Danbury Township as to purchase, installation and maintenance, I hereby grant said request.” Because of the recent loss of lives and the results of intersection studies conducted previously for Bayshore and Danbury North Roads, as well as SR 163, which intersects Northshore Boulevard and Englebeck Road, the Trustees agreed the LED signs needed to be installed now. It was discussed the LED signs could be placed elsewhere within the township if it was determined by ODOT a traffic light should be installed.
Approve Purchase LED Signs Ms. Rozak moved to approve the purchase of two yellow LED flashing signs stating “Cross Traffic Does Not Stop” from TAPCO (Traffic & Parking Control Company, Inc.) at a cost of $2900.00. Mr. Hirt seconded the motion. All voted yes. Motion carried. Chief Mike Meisler will contact Tom Feldmann at TAPCO to place the order. The maintenance staff will install them and the Township will maintain them as well.
Fire Mr. Hirt reported that the Lakeside Volunteer Fire Department handled 39 calls during the month of October. (29 –EMS, 3-Fire, 2-Motor Vehicle Crashes, 3 Alarm Calls, and 2-Public Service Calls) Mr. Hirt also reported that the Marblehead Volunteer Fire Department handled 47 calls during the month of October. (39-EMS and 8-Fire Calls)Mr. Hirt said that there was no new information to report with regard to the fire departments joining forces.
Safety Regarding the CPR recertification for Township employees, Mrs. Seamon reported that representatives of Firelands Corporate Health were available on Wednesday, December 14, 2011 from Noon until 4:00 p.m. Mrs. Seamon said that Safety Coordinator Deborah Burley-Biro was concerned with overtime and had asked her to inform the Trustees. Upon discussion, the Trustees agreed to reschedule CPR recertification for January.
Zoning Zoning Inspector, Kathryn Dale reported that to date in November nine permit applications were process and the fees collected totaled $266.76.
Board of Zoning Appeals - Special Meeting Ms. Dale reported that the BZA would hold a Special Meeting beginning at 3:15 p.m. on Monday, November 28, 2011 at the Danbury Township Hall, 5972 E. Port Clinton Eastern Rd., Marblehead, Ohio for the purpose of approving the October 19, 2011 meeting minutes and the Decision Sheets for the following cases:
#2011-139 -- 8980 Hartshorn Road #2011-122 -- 315 N Channel Grove Road #2011-133 -- 518 N. Erie Beach Road A copy of the aforementioned documents may be viewed at the office of the Zoning Inspector at the Danbury Township Hall during normal business hours.
Zoning Commission – Public Hearing Ms. Dale reported that the ZC would hold a Public Hearing on Wednesday, December 7, 2011 for the purpose of reviewing Text Amendments (case#2011-147) to the Danbury Township Zoning Resolution. Ms. Dale also reported that the Ottawa County Regional Planning Commission recommended approval as presented at their November 15, meeting. Amendments include: • “L” Lakeside District; Section 3.1.5, creating 3.1.5.0 Lakeside Business Overlay District, and amend Section 5.1.2 for accessory building height. Other amendments were: • Section 5.5 for signs; • Section 5.6 for fences; • Section 3.5 regulations for transient vendors • Additions to the zoning definitions in Section 2.2.
Zoning Updates Ms. Dale reported that the Zoning Office would be closed on Thursday, November 24, 2011 and Friday, November 25, 2011 due to the Thanksgiving Holiday. The training in Toledo was very informative and those who attended were looking forward to additional training after the first of year regarding “Roberts Rules” as well as the “Ohio Sunshine Laws.” A Draft copy of the by-laws for the boards and commission was nearly completed and will be forwarded to the County Prosecutor for his review. Ms. Dale said she was waiting to hear from Bud Chasteen at Computer Resources regarding the offsite back-up system for the zoning department.
Mileage Reimbursement With regard to the Trustees approving mileage reimbursement for ZC member Jim Jacobs, Ms. Dale informed the Trustees that Mrs. Seamon had received an inquiry from a member who choose to drive separately to the training. It was clarified that transportation to the conference was provided as well as that travel expenses are to be approved prior to the time the expense is incurred.
Residential ADA Accommodation Language Ms. Dale provided language changes for the Residential ADA Accommodation policy. Ms. Dale reviewed each change to the policy in detail. A brief discussion followed which included that Ms. Dale had been very thorough and the proposed language covered all basis regarding granting ADA accommodations for non-medical and medical ADA accessibility.
Mr. Hirt moved to amend the Residential ADA Accommodation policy as recommended by Zoning Inspector, Kathryn Dale. Mr. Scott seconded the motion. All voted yes. Motion carried.
The revised policy and application were as follows:
Administrative Variance Procedures for Residential ADA Accommodations ADOPTED by the Board of Trustees on November 22, 2011 1. Any residentially zoned property in Danbury Township may install one (1) temporary or permanent ADA Accommodation (e.g. handicap ramp, electrical lift, handrails) to the exterior of a principal structure on said property with the following requirements: A. Such ADA accommodation shall require a zoning permit at a fee of $10.00 and obtain an Ottawa County building permit prior to commencement of construction.
B. Such ADA accommodation for residential use shall refer to the commercial Ohio Basic Building Code for construction guidance to ensure safe assembly, heights, distances, entry access and slope. C. Such ADA accommodation shall be permitted to encroach into any rear or side yard setback, up to the property line, provided it is not enclosed or covered so as to circumvent the zoning requirements for district setback requirements for structural additions. D. ADA Accommodations may encroach into a front yard setback with the following conditions: i. No such accommodation shall encroach or be located within a public right-of-way. ii. The maximum encroachment shall be 25% of the linear setback distance and shall cover no more than 10% of the front yard setback area. a. Any ramp type accommodation constructed of poured concrete which also serves as a sidewalk/ walkway to the main entrance of the principal structure shall be exempt from this requirement. iii. Any ADA accommodation that is medically necessary, supported with a doctors medical verification and cannot satisfy these requirements may request additional review and approval by the Board of Trustees by filing a Reasonable Request for Accommodation form at no additional cost prior to a zoning permit being issued. iv. Any ADA accommodation that is not medically supported and cannot satisfy these requirements shall be treated as an area variance for the district in which the property is located and may file an application with the Board of Zoning Appeals in accordance with the Danbury Township Zoning Resolution. 2. Any ADA Accommodation installed onto a structure containing a nonconforming use shall not require a use variance from the Board of Zoning Appeals if such ADA accommodation is in accordance with these requirements. 3. Any property owner who wishes to install an ADA accommodation shall make a good faith effort to install such accommodation that is reasonable in size and the least intrusive to a neighboring property for the sole purpose of assisting a person, who resides at the property or for visitors to the property, into the principal structure where the natural grade of the property is lower than the finished floor level of the principal structure. 4. Any ADA accommodations shall be maintained and keep in good repair. Upon notification from the Zoning Inspector, removal of such accommodation may be warranted if there is visible and/or structural deterioration or damage that jeopardizes a persons health, safety and welfare.

Probationary Period Mrs. Seamon asked the Trustees to verify if Kathryn Dale had a probationary period. The Trustees informed Mrs. Seamon, that a verbal agreement was made when Ms. Dale was offered the position and there was no probationary period. Ms. Dale is to earn sick time effective November 22, 2011.
Fiscal Report Fiscal Officer Shelley Seamon provided financial reports for the Trustees, which detailed the finances of the township through November 23, 2011. Mrs. Seamon said she would be working with each department regarding updating the 2011 Inventory as well as working on the 2012 Budgets.
Ms. Rozak dismissed the Department Heads at 7:50 p.m.
Winter Newsletter The Trustees reviewed the content of the newsletter. Upon discussion, the Trustees agreed to have the newsletter printed and distributed.
Dog Park Signage The Trustees reviewed and approved the signage for the new dog park, as presented by Allure Signs & Printing. Ms. Rozak said that Stevie Rinaldo would provide the Township with a check for $1,226.00, for the purchase of the new sign. Ms. Rozak said that the funds had been donated, but she was not sure by whom.
The Keeper’s House Signage A brief discussion was held regarding another design, which was obtained from Scott Halblaub of H2Designs. The design provided the Trustees with three options and costs ranged from $1,143.00 to $1,226.00. The Trustees also reviewed the design submitted by Allure Signs. The Trustees agreed to obtain additional information regarding the materials being used for construction.
Ottawa County Township Association Ms. Rozak moved to approve membership dues for the for Ottawa County Township Association in the amount of $228.00. Mr. Scott seconded the motion. All voted yes. Motion carried.
Safe Routes To School (SRTS) Update Mr. Scott provided an update regarding the meeting that took place on November 16, 2011 at Danbury High School. Mr. Scott said the presentation given by Matt Simpson of the Floyd Browne Group was well received and feedback from school employees was very positive. A brief discussion was held regarding obtaining support to split the $12,000.00 cost to hire the Floyd Browne Group to compile the plan as well as prepare the SRTS grant. Upon discussion, the Trustees decided that Mr. Scott would take the lead on the project and keep the Board informed as progress was made. Mr. Scott said he would be contacting Mark Mulligan regarding if interested entities could enter into a contract for the project.
Approve Payment of Bills After examining the following bills in the amount of $46,689.96, Mr. Scott moved that they be accepted and warrants for the various amounts be drawn. Grant Reimbursements Ms. Rozak moved to approve repayment to the general fund in the amount of $7,921.03, from the Clean Ohio Trials Fund grant due to the receipt of a reimbursement check that the township received from ODNR. Mr. Hirt seconded the motion. All voted yes. Motion carried
Mr. Scott to approve repayment to the general fund in the amount of $4,589.02, from the Recreational Trails Program grant due to the receipt of a reimbursement check that the township received from ODNR. Mr. Hirt seconded the motion. All voted yes. Motion carried.
Special Meeting Scheduled The Trustees will hold a special meeting on Monday, December 5, 2011 at the Township Hall beginning at 6:00 p.m. for the purpose of approving bills due to a period of three weeks between regular township meetings. Authorize Fund Transfer Mr. Hirt moved to authorize the transfer of $400,000.00 from the Star Ohio investment account to the Marblehead Bank checking, for the purpose to cover upcoming payments for the Fire/Ems contract payments as well as payment to KF Construction for the Meadowbrook trails. Mr. Scott seconded the motion. All voted yes. Motion carried.
Comments & Concerns Rita Mahler expressed written concern on the sign in sheet regarding why Mr. Smith was allowed to comment during the meeting on several occasions. Ms. Rozak explained why Mr. Smith commented while the Trustees conducted the business portion of the meeting.
Jodi Kopanski said that in speaking with residents in the community, feedback regarding the SRTS program to install sidewalks and biking paths in the Township was all positive.
Peter Corrado had several comments regarding the Residential ADA Accommodation Request. The Trustees and Mr. Corrado very briefly discussed his concerns as well as who had been consulted with before adopting the revisions to the policy.
Ms. Rozak moved to go into Executive Session to discuss employee compensation at 8:30 p.m. Mr. Scott seconded the motion. All voted yes. Motion carried.
Ms. Rozak moved to reconvene at 8:49 p.m. Mr. Hirt seconded the motion. All voted yes. Motion carried.
No action taken. Ms. Rozak moved to adjourn the meeting at 8:49 p.m. Mr. Scott seconded the motion. All voted yes. Motion carried.
